Leaving you guys
Not that I have been around long, but I have to say goodbye to all. I am leaving the Mazda brand after I plan on submitting a Lemon Law claim against my RX-8 which has been out of service 34 days now in the first 2300 miles and two months of ownership due to non functioning A/C. Mazda called on the 29th day out of service and offered to put me in a new 05 when one would become available. Great idea on maybe the 10th day out of service, but too late. I will opt for the refund of payments option per the lemon law and get something else non Mazda. Hate to say it, but the way I was treated by the corporation-ie lack of urgency to fix problem, and no attempts to make a reasonable accomodation have soured me and the brand. I wish the best of luck to all of you with your 8's and rev on.

Most likely a 05 Legacy GT-250 horse 250 torque and 0-60 in 5.6 per Road and Track. Very slick car and obviously great in the snow. I had a wrx and probably shouldn't have sold it to get the 8.

Drove one
I drove a sti and it is amazing. Problem is I plan on leasing and they do not lease well and due to my job, I need to have a car that is a little lower on the fast and furious scale.

Days out of service is the key
If the vehicle is out of service for more than 30 days in the first year of ownership-for one problem or a combination of problems it qualifies as a lemon. A rattle wouldn't qualify, but something like a/c not working would. My wife is extremely to sensitive to heat and it would not be safe to drive the vehicle in 95 degree summer days with no a/c. It has to effect the value/safety and some other parameters, but according to my attorney no a/c would definetly qualify.

Sorry to hear it, rexleggt. My A/C is SO efficient that it gives me the sniffles. But, I can't blame you if you've tried to get it fixed without results after this much time. Good luck with whatever you replace the 8 with.

Agreed - this sound more like a problem of dealer service incompetence than anything else. I would've yanked that puppy and taken it to another dealer if they were having such problems fixing a fairly minor problem.

My '02 VW passat W8 was ot of service for 60 days in 13 months, had 32 jobs against it and was in the shop 14 times for those jobs. Only one or two of them were safety related. They refunded me my payments and down payment (but not taxes, title or licence fees) minus a usage fee based on milage. After 13 months I pocketed about $7000.

Yes it's sad to see you go but it's more sad that you are soured on the Mazda brand because of the lack of service at your dealership. I don't see how a non-functioning AC constitutes the car as a lemon, my understanding is that lemons are vehicles that have been prone to many problems, but then again it varies from state to state.
Hope you win your legal battle so that you can get into your Legacy.

To hear that a RX came out a lemon but it happens in the best (or most expensive of families) I had a friend who returned 2 BMW's one 325i and one 330 because of problems. Usualy this kind of problems are dealer related (haveing incompetent a-holes working on the cars has a negative efect on any car) rather than brand related. My friend went to another dealer and bought himself an X3. hasn't had one problem with it.
Anyway get a car you like and enjoy it. Good luck and even if you dont own the 8 you can still keep us posted. It is always good to have people give a fresh opinion bsides our biased rx8=GOD (myself included) opinion. Not that any other opinion would matter much to us :-) just teasing hehe

This is an independent dealer problem NOT a MNAO problem. Let's get it right I don't know all CA laws pertaining to "Lemons" but leaving your car at the dealer for 30 days to fix your ill-functioning AC to me means you should have gone elsewhere. Yes, the dealer bears the responsibility but just sounds to me you should have tried some other avenue. Did you speak with a service supervisor? Service Manager? Your sales associate? Sales Manager? Lot/Dealer Manager? I honestly don't see you and your Lawyer being successful in labeling this car a Lemon. There's no safety problem here as stated.
Did you really want this car in the first place? Trying to pin this car a Lemon is the wrong way to go. Sorry to sound so harsh but I wanted to make sure you know the Mazda Brand is not the problem. Good luck to the next Automotive Brand you buy in too :D

88gt - thanks for raising the "user error" issue here. I don't understand why if you're not getting the service you want from a dealer that you just don't switch dealers.
Some years ago, I was having issues over and over again with a fuel leak from a 96 Dodge Grand Caravan we had - it was dripping fuel from the fuel tank - and I took it in three times to the dealer and they said "can't find it".
So finally I got frustrated and went to the Plymouth/Chyrsler dealer just down the street. Their service people said "that's insane" and replaced the entire fuel tank/fuel pump assembly under warranty and the problem was cured.
I'm guessing either your dealer couldn't figure out the issue or didn't know how, or just didn't care (or if you're not nice to them, didn't want to). A switch to a different dealer might have saved the day. And the car.
