TX Just got car back after being hit by Drunk Driver

I finally got my car back after being hit by a drunk driver. over $9000 worth of damage. The car runs ok, but i had to have my motor mounts replaced because they were cracked. I am having one other concern though. It seems that at times while driving (the car has a tiptronic transmission) it seems on ocassion that the car goes in 3rd gear and does not shift when it is supposed to. it will be in 3rd gear even though i'm going 50mph. this is not consistent at other times. At other times the car can be in 5th, or 6th gear going 50mph.

What problems could be underlying regarding this??

Check the fluid level. You may have to take it to the shop to check for a bad solenoid or connection.

ouch! check the fluids and get a scan if there any CEL's.

I spoke with the Mazda Dealer and they stated that that is normal with that type of car is this true?

You may need to take it around and have them drive with you so they can see.

Glad you are ok

Idk, it used to do this in my mazda 6. But that was due to the fluid being old and the transmission was overheating.
Does yours feel real warm where the Gear lever is?

Check the fluid, the looks and smell will tell the tail

I will take some pics this weekend, it's been raining alot here.
It looks the same, but i'm concerned with the Trans sticking in third gear.

They added fluid but I'm not sure if they flushed the transmission fluid.
It's still sticking though.

Just an Update!!!!!!!!!!!!!
I got my car back, and everything seemed ok.
So it's been raining here in texas alot last month, etc. so i'm wondering why i'm skidding all over the place anytime i go over 45-50mph. Come to find out THEY NEVER DID AN ALIGNMENT!!!!! They did not do a wheel alignment after over $9000 worth of repairs and i specifically asked them if they did an alignment on the car. I was highly ticked off about this.!!
I couldnt believe it. My car was literally sliding all over the place, EVEN TODAY!!.
so they are going to fix the allignment, but if i have an accident on the way home from work, it's going to be on their heads!!!! (The Insurance Company)
I'm glad that I also filed a diminished value claim with the insurance company they made me an offer of $2000. Which i am going to dispute. after $9000 worth of front end repair, i'm concerned that other problems are going to come up in the future, especially seeing how they did not do a front end alignment which should have been standard protocol.

Transmissions are controled electronically.

The module is bad or the connection.

Insist that it be checked and notify your insurance compy. Do it in writing too.
Tell them the car is not drivable in this condition.
