In my mind the cop's credibility is certainly in question...or at least his laziness in getting his facts straight should cast a big shadow on it. if the cop has a REAL speeding motorist and has the proof all he has to do is get a few bits of data correct on a slip of paper...if he can't do that then he has no right handing out tickets. he is too sloppy and lazy to be in his position.

 

Just out of curiosity, how fast do you think you were going? Anywhere close to 'hmmmm 84'? If you know you weren't going that fast then I see no reason why you wouldn't be able to fight the ticket in court. Most legal offices will give a free consultation so you might be able to visit or call multiple lawyers offices and get several free consultations and see what they all think.
When you are in court if you don't think you will be able to win you can also get a plea bargain and that will usually take a good chunk off of the ticket. As others said take a good clear picture of your vehicle showing that it is indeed green, and make sure to bring your car's paperwork that says it's an 05 and green.

My girlfriend recently got one of these 'here-say' type tickets where one officer saw her commit the offense and another officer(who was not able to see the offender) wrote her a ticket. We went to court to fight it hoping that only the issuing officer would be there and not the one that saw the offense committed. They were both there, though, so she took a plea bargain and got $100 removed from the cost and that paid for defensive driving and the court processing fees.

 

come on....green looks black unless you know to look closely as is the fact that it looks like a 2-door unless you know to look for the latch of the second set of doors. pay the ticket and move on...

 

Can't hurt to try and fight it, on radar guns, they don't have to show you the gun however they DO have to show you the calibration records.

 

His information would atleast convey the year of the car, It's not like the officer used a typewriter to issue the citation. He couldn't have just mistyped a 4 instead of a 5...

Understand the simplest concept about a ticket: It's given to YOU, not your car. If the license plate and driver's license information is correct, then that's all she wrote!

Tickets are given to people, not cars. Cars don't break laws... Otherwise, with that logic, we'd have a lot more guns behind bars and on death row than people.

Man, if you had a ticket, you would probably be perturbed also. Especially if they wrote you up wrong, that is just wrong. When the insurance form is sitting right in front of you and it states the year, how are you going to get that wrong?

An 84 ticket; I know is about $180 dollars in PA and that's without a seatbelt. I do not know all of the details, but it may be over $200. For most people, that is a high amount of money.

Similar thing happened to me last year, got nailed in a construction zone 20 over in a speed trap (Saturday morning, money grab type sting on a freeway exit ramp).

The cop wrote zx8 on the ticket.

I got a layer and went to court, case dismissed by the judge due to paperwork error.

It did take some back and fourth between the layers, so I guess it depends on the prosecution, but I got off - I would say I was very lucky though (the cop turned up - apparently he doesn't normally) and speeding was the only charge.

So it is possible - but I suppose many factors can/will influence the outcome.

This was in Houston btw.

Get a layer, dust off your best suit, cross your fingers and practice looking remorseful would be my advice.

i wouldnt call an attorney's office unless your willing to pay at least $500-$1500 depending on the attorney. I've worked at a Law firm for 3 years now, and yeah well i dont think it'd be worth it, unless you just called to get some free advice!!

Easy 1 is coreect. License plate and registration is correct.

You can not fight this. If you say another officer said I was speeding so he wrote me the ticket for the othe officer it won't work.

The Policeman never wrote that on the ticket, and when asked by the judge... Did you see him speeding? The officer will say yes.

The will take the officers words.

Not true everywhere. When the cop didn't show in New York the Assistant to the Assistant Deputy District Attorney asked for a CONTINUANCE on my ticket! Only after I complained did the Judge say that it's the DA's right to ask for a continuance but in my case he agreed to drop the ticket.
