un-frickin believable

I had a similar experience. As I was traveling through a supermarket parking lot at about 5-8 mph a woman backed out of her stall without looking and backed right into the right rear fender of my car.

I stopped and calmly exchanged information and after looking at the damage almost considered not making a claim. However, something in the woman's demeanor just wasn't right.

I went home and called my insurance agent, he agreed I should bring the car in and get it inspected. The damage was buffed out easily. The funny thing was... 15 minutes after I called this same woman called (we had the same insurance agent making the claim that someone rear-ended her!!!!!

So I rear-ended her with my rear fender...? I was pissed and so was my insurance agent for being lied to. You have to follow up on stuff like that...

Anyway, State Fram dumped her for being disingenuous and I got my car fixed ON HER. I insisted she reimburse me my deductible or face a law suit!

You get to pick the body shop. Once you've chosen one to your liking, then as long as her insurance company is reputable you're fine as far as the car goes. Get them to directly cover your rental car, so you won't be out of pocket waiting for reimbursement.

Since you were injured, you MUST get a lawyer. It won't cost you a nickel to consult with one. They all work on contingincy.

One detail...if your medical insurance covered the ER visit, then they'll also be part of the case against the woman who hit you. Your lawyer should know that, but there was just a big story in the news about a woman whose dimbulb lawyer did not know and wound up in the red.

pics or it didn't happen lol. The damage sucks but it doesn't look too horrid since the bumper popped back out. the frame is crunched a bit underneath in the rear though.

DANG...Sorry to hear and see this. Do you have uninsured motorist coverage? Just in case she doesn't have insurance, you never know. What did the cops say? Was she at fault? You could talk to your insurance company and see what they would do. Castrucci's Auto Mall (Mazda) shouldn't be a bad bet, but I'm sure that if your insurance company handles it they will have a body shop in mind.

The other driver drove away, she's automatically at fault.

How is your head? I hope you heal quickly.

haha, the front of my car looked exactly like that! someone hit it in a parking lot. use a U-shaped piece of metal, hook it into the edge and pull out. i swear it will pop back to 95% of what it was before. haha. its smirking now.

as for the dude in the front, many people have jobs that if they miss once they lose the job. this guy probably had such a job and could not afford under any circumstances to lose his job.

body kit time! i wanted to get the buddy club kit, but 6 weeks ship time from japan was a deal killer.

My car really is smirking now.. maybe i should leave it that way. haha yeah right. but if anyone has ever seen that pixar movie Cars, it kinda looks like it belongs there now.

That sucks, what a bunch of ******* idiots in that accident.

My worry is that my winning blue looks so shiny and expensive that if someone hit it, they'll just take off so they don't lose insurance bonus or have to pay. Sucky situation with an almost mint car.

i know haha! i don't know why he thinks it's so funny. he's the one with the banged up hind end.
Yeah i agree that the damage doesn't look as bad as it could but there's a bunch of **** crunched in behind the scenes. It'll be alright though. Shouldn't be anything that can't be fixed.

So the second time she hit was intentional? So that she could go around your car and drive off? Isn't it Manslaughter with motor vehicle? lol....

If her insurance company is not treating the claim seriously, talk to your insurance company. You can get the car fixed under your coverage, and your company will then collect from hers.

Your company will treat you better because a) you're their customer, and b) they know they'll be getting the money back. This will not count as an at-fault accident on your record. Worst thing that can happen is that you may not get all of your deductable back - just depends on whether they need to take legal action to recover. But that's better than living with a shlock repair job.

Ask your lawyer about this.

finally...

6 weeks later I finally got clearance to take the car to a shop to get it fixed. yaaaaaay. took it to matt castrucci's in dayton since it was the only mazda dealer close by that was a progressive "guaranteed" shop. I hope they're not retarded and they know how not to flood rx8's. I could see a lot of bad scenarios coming out of this. lol just hope for the best!!
Oh and they gave me a nissan murano for a rental.. never owned an suv so i feel like a bus driver compared to being in the 8

My wife got rear-ended in my 8 while taking it to the dealer for me last fall. It had less damage than yours, and the bill was something like $2500 because they have to replace all the styrofoam blocks, and there were some bent brackets, and the cost of feathering the new paint into the fenders. Didn't cost me a cent since the other person was totally at fault.

Good luck with yours.

wow, thats nuts, but at least your 8 will be on the mend, as well as your head etc.
i always worry about sitting at the lights or a stop sign and see people pull up behind you quickly. what i end up doing is put hand brake on and lift my foot on and off the brakes a few times to draw attention to me being stationary and you usually see them slow down considerably. but its only if i am the only one at the lights and those behind me seem to be coming in a bit too fast.

i suppose people panic, and thats why she hit you twice trying to get away and ignoring you etc. they see an expensive car and the flight response kicks in and hope, the maybe they didn't notice magic spell got cast, and i'll just drive on.

but hopefully you'll be back on the road and the insurance pays it all. having the uk model, i am not fussed on those orange signal indicators beside the headlights, so see if you can get clear ones with orange bulbs unless its US law?

i do like the front bumper pic you took, it does look like your 8 has an Elvis lip now lol, or a tooth missing and has a crooked smile.

but good luck with everything and i hope it will work out for you.
