I believe the US started requiring HIDs to be self leveling about 6 months ago. Also aftermarket HID kits became illegal. The self leveling is pretty much a world wide requirement now (other than countries that haven't caught up yet).

The RX-8 has sensors on the front and rear right suspention that it uses for HID leveling and DSC input.

Fake HIDs are silly, but some will still use them. They are called "posers".

Yes and the auto-leveling systems are mandated by federal law also. Without it you run the risk of blinding oncoming drivers and that can lead to an accident. Some cops are known to ticket cars with illegal headlights. In my opinion it would not be worth the hassles down the road.
