Thumbs down Damn BMW! (My accident)

Yeah, not really much to say here...I was driving by when an 03' BMW 325i launches his car in reverse into my passenger side...idiot didn't check before coming out either and confirmed with police it was his fault. Guy tried to screw me over by saying i was "flying" and not looking. But clearly, if you look at the pictures...I was already past him when he hit me...damn it...why oh why did i decide to abide by the speed limit that day

More pic's

Damage basically spanded from my front corner light all the way back to my back bumper - the other guy's bumper was falling off a bit and scratched up pretty bad - evidently my strakes kinda helped pull it off...

Yeah, ever since i got my 8 i have never been this bummed...

and what also sucks is the idiot works in my building here at work - I'm going to have to restrain myself from strangling the guy if i see him today.

Well....accidents happen and they suck. I'd be pissed too. At least it's minor damage.

In all serious though, sorry to hear the happend...The damage doesn't look all too bad and atleast you'll still be able to drive it around so you don't have to have it towed...

In my accident I wasn't able to drive it, for the rest of the day it was a huge pain my **** too!

Hope everything turns out okay and it looks good as new, if you have Precision Auto's in your area use them, they did a bad *** job on mine. Looks as good as new!

Clearly your fault, you must have missed the part of driver's education where they tell you ALL bmws come with a title to right of way, passing lanes & a requirement that blinkers NEVER be used.

Thanks everybody -

I have my 8 sitting at my servicing dealership not too far from my work (Tustin Mazda). They have a collision center there that seems pretty decent

anyways, the guy's insurance company is scheduling a recorded statement later today to get things rolling here. I have my story down but i've dealt with attorney's before so i know it's not going to be smooth sailing if they're ****** (which i'm pretty sure they may be). I just want to get my 8 back looking and feeling good as new asap.

optimistic side: once all this gets cleared up i'll be posting pics immediately...like 4 to 5 weeks like they estimated kind of immediate tho =( wahhh!!!?

it was a grey bmw but had one of those black rubber things across the back

update: I NOW HATE ANY QUESTIONS ASKED DURING A RECORDED INSURANCE STATEMENT.

bastards like trying to twist stuff up...

How Much!?!?

Update:

Just received (more like just remembered) the estimate from the ins. guy or whatever...

Total cost: $$3,756.00!!

Lucky for me though according to the print out of everything, it's all body damage - nothing to the frame or engine

The shop i took it to printed out a statement requiring my signature to get everything started but i'm hesitant because my insurance agent said not to because evidently the guy who hit me is claiming it was MY FAULT!?!?. My ins. guy said to hold off on signing anything just incase...he said it shouldn't be anything to worry about and everything should be ok to go starting tuesday next week...but thanks to that i'm worried now

I think if you were "flying," the guy would have 1) seen you, or 2) heard you, or 3) you would have gone right past him. Sorry to hear it happened, hope everything goes okay for you, and it doesn't get twisted around to make it look like you're at fault, which it's pretty clear that you're definitely not.

You're right! Oh my god, RX-8s must get hit a lot more than other cars!!!

the guy who hit you is ridiculous....if you look at the damage on your car.....you can clearly see that he hit you at the front of your passenger door which means you would have been directly in his rear view had he checked......some people are just stupid......thats why the mirrors are there.......what an *** hat.

Update:

well my hunch was right ladies and gentlemen...the collision center thing was too good to be true...evidently had i signed the paperwork to get everything started my insurance would not have covered it because they haven't confirmed with the other guy's insurance that they're going to take care of it - or atleast not yet - apparently things are getting a little more sticky and the guy in the bmw's insurance company isn't helping any - the return of my 8 is looking to take about a month and a half now IF NOT LONGER. I'm going back to the collision center today to pick my 8 back up and take it home till i get the ok from my insurance company.

If by this time next month my 8 isn't already being worked on or returned...bmw is going to have 1 very injured owner...

Your insurance should be paying to fix your car minus your deductible and then they will go after the other driver and recover their money and yours (the process is called subrogation). You shouldn't be having to wait on the other driver and his insurance getting their act together.

Actually they should be paying it in full. When you involved in a no fault accident, your company should fully cover it. you only pay the deductible if you share some fault in the incident.

Or, if you just have liability, and don't have uninsured motorist, then you may have to pay a deductible if you are hit by an uninsured driver.

It sounds like UM coverage isn't going to come into play, as the BMW driver is clearly insured.

What you've run into, Atilla, is a driver who is trying to shift blame in the vain hope that his insurance company will not up his premiums. Unfortunately, some inexperienced, unscrupulous or just not very bright insurance adjusters - they don't often have the "A-Team" handling minor property damage losses - will latch onto statements of non-fault by their insureds even if they are clearly self-serving and not supported by the objective facts. The bottom line is you had the right of way, and short of an admission by you there is no way those numb-nuts can prove that you contributed to the accident under the facts as you've described them. At the end of the day, the BMW driver and his insurance co. are always going to lose this battle.

As Hyperborea stated, if BMW guy's insurer is taking the position that he is not responsible, your insurer should step up and pay for the repairs and then subrogate against BMW guy (assuming you have collision and not just liability coverage). You should get your deductible back when that process is complete. There's no reason for you to be waiting a month before they even get to work on your car.
