Accident advice

I could use anyone's advice if they're ever been through this.

I was driving at about 2:30 AM on the freeway. There's a bit of road construction on the left side closing two lanes. There are three more lanes open and I'm driving in the middle one. Suddenly I see two orange pylons in my lane and there's no way to avoid them. I hit one of them that cracks my front end, knocks our my foglight, and pops out the fender and wheel well moldings.

Can the city be liable for this? If not, should I get this repaired through insurance? Or maybe I'll just have to buy the MS kit now. Either way, it sucks so if anyone has any advice on what I should do, please let me know.

You will have to prove that the city was at fault for them to pay it... only way is if you took pictures of the location at that time, and prove it was the city's negligance at fault.

Insurance... depends on your deductable. If the damages is just your bumper, perhaps getting another stock one from another user OR just go the MS Front bumper route.

I'm sure people will ask for pictures of this anyhows... if it's MORE than just the front bumper area... well.. guess insurance can help.

I had a situation similar to this, 3 lanes of traffic i was in the left hand lane with a car in the middle lane next to me. I came up on 2 workers shoveling asphalt into pot holes with no signs of warning in order to miss hitting a worker the car in the middle moved left into my lane and I had to move left as well right into a pot hole. I broke a rim and blew a tire and after contacting the city, I was able to pinpoint what company was doing the work. There were virtually no questions asked because there were no "men at work" signs and they paid for the repair.

I love this response. We KNOW that! There’s the way things should be and there is the way things are. It's not like the guy piled it up in a fog ridden fiery crash. He just hit a small cone at night. I recently avoided a large orange barrel on a highway down in Alabama. I popped up over a hill at highway speed and thankfully I knew no one was around me and made that emergency lane change to ovoid. What a car!

Anyway, send the info. to the city and they will research and might tell you that a contractor was working in the area at the time and refer you to them.

I just wanted to add that I just scratched my rear bumper recently and the dealer priced the bumper cover at $279 and to paint another $250. If you know of a better place to buy these body parts please let us know.

If it popped out the fender, you've got a lot more damage than you think. Here's a partial list of parts that will likely need replacing:

Front Fascia
Foglight assembly
bumper crash absorber (often foam don't know what's under the RX-8's bumpers ...)
Reattach fender lining
Straighten fender
Paint & Finish

Probably $1800 in damage or so.

I highly doubt I'll need any fender work or the crash absorber, but I'm checking into the price of a new front bumper and the mazdaspeed kit. I'll keep you posted.

If you are going to tell it to your insurance do it with diagrams and pictures, not a phone interview. Cause they might not be able to picture it in their little insurance claims minds. In fact dont even claim it. Insurance is for major accidents with other cars, so you dont get sued. It is better to come out the pockets, cause I went through something similer and got the same deleted responce from ER Resident DR. better clear your replies though an attending ER Resident.

It will Probably be around $1200. Around $600 in part and around $600 in labor.

Factory Bumper replaced, painted and labor will run you just uner 800, $817.42 if you need the center grill replaced as well.....Just had this done 2 weeks ago

this sounds about right. upon closer inspection, i would need to replace the bumper ($388), the foglight bracket ($40) and if I really wanted to, then the panel underneat (not sure how much that costs).

I'm considering just replacing the foglight and leaving the cracked bumper until it gets to where I can't stand it.

Suing a city is an almost impossible feat.
Since people are getting body kits now you may find a cheap stock bumper on ebay. No one wants to drive their 8 with a cracked body piece.
