21st car is an RX8, new engine!!!???
Finally got an 07 RX8 with 66k a week ago...I already knew what I was in for and wanted to get a new engine by the time my 8yrs/100k warranty was up...
I drive off the lot happy with my new car which was purchased from a dealer who buys car from a local Manheim Auction in Orlando (I own a small private shop working mostly on Toyota/Lexus, BMW and Honda/Acura and trust this auction house, which is right next door to me) This car was a "green light" and came with service records. Within 3 days of 9000rpm driving, the check engine light came on and I lost power at high rpms. I scanned it and got code P0420 saying the catalyst system, and to my surprise, there was no cat! The previous owner deleted the cat, welded a bung in and kept the factory resonator. When I took the car back to the dealer, he accused me of removing the cat! I know its illegal for a dealer to sell a car without a cat and told the dealer to jack up the car and look underneath at the old catless pipe and untouched nuts and bolts after he told me "prove it" He then kicked me out his dealer but not before telling me that he'll repo my car if I dont pay. He wants Mazda to tell him that there is a problem before he goes to the auction house and makes a case...the problem is if I take my car to Mazda and they see no cat, the engine warranty is void and Im screwed. So my question is, do I get a lawyer because of principal, or just take the loss and buy an aftermarket cat and THEN take it to Mazda to do a compression test and (hopefully) replace the engine? Im going back to driving my BMW's

call the dealer first and explain the problem over the phone. If the dealer is reasonable at all, they won't give you any crap and should be able to provide what you need for the other dealer. Not having a cat is NOT sufficient legal grounds to void the engine warranty.
