Well looks like im getting my car fixed......
**** is gonna be worth nothing with 2 accidents on her so i dunno what to do.

They are currently ripping down the car and re-estimating damage so ill keep you guys updated.
Oh yea....estimated completion date is about December 5th 2009.

How much is the repairs vs the value of the car? My insurance estimate showed me those numbers and gave me the requirement before totaling.

1. Police are considered expert witnesses on all accounts. In my worst accident I was lucky my passenger was on the job.

2. Honesty is rare, most of my police report always said conflicting stories because the other guy lied, or we both did LOL.

3. Did you get your car moved?
4. Do YOU want the car repaired?
If not find out how close the repair amount is to the Total value of the car, maybe talk to the repair shop to drive the cost up a bit, the insurance Co won't go for it if they cant come to a cost agreement (inc labor), and will ask you if you'd want to change shops... you of course refuse, and they will give you the option to total. Depends on the appraiser you get, but thats pretty much how it goes.

Good luck, and enjoy waiting the next 5 years for your money LOL (it took me that long once).

The repair shops can't up the costs nowadays in NYC, apparently because they have to file for taxes based on the cost of repair. That pretty much pushes them to keep it accurate, if they get audited.

Yes, I moved my car to my body shop.

Police said i was right and he was wrong = i win (he admitted it)
Is there even a case if the other guy admits to guilt and violation?

I don't want the car repaired but the value of the car right now is 17.5k vs the 8-9k its gonna take to repair. So of-course they not gonna payout an extra 8k so i can get the car totaled. His insurance is going to be cheap and try to save every penny off this.

Also note this dude is pushing his 60's so i could even say that this dude is ******* old as hell -- hes going blind -- **** like that -- i dont know him


I make money so i don't care how long it takes as long as i get paid for: Time loss/going through all this hassle (cant imagine what this would be like if i were in school or had a job), my car in the shop for 3-4 weeks, my car payment without my car, my insurance getting bumped, pain and suffering, transportation to and from therapy........he also tried to bribe someone ($200) on the street to say he stopped (isnt that a felony?)

PLUS THIS DUDE CANT EVEN SPEAK ENGLISH! How the hell is he driving a cab?
Oh and also this isnt a YELLOW nyc cab....its those cabs that you call like car and limo service so im not fighting NYC on this im fighting him and his insurance and then the cab company.

Like this dude is finished

Labor rates vary. Up the rate, simple as that.
P.S. I'm not saying that it should be done, just that it can be.
Granted, now that Juan posted the estimates, there's no way to push an extra 9k out of it, his car must be low mileage.

Honestly bro, you'd have been better off if it was city, they pay out faster.
The accident I referred to where we waited 5+ years for the payout was a private livery. Granted this might be a different situation, and I'm not trying to downplay it at all, just being real with ya.
Don't spend what you got today and expect that cash tomorrow, cause it ain't happening.

Did you break or fracture anything?

Juan, what year is your 8? How many miles? 17k seems extraordinarily high - mine was rated at 19k when it was a 2006 model with 500 miles on it

Yes we are talking about livery cab here. My situation is different. No i didnt break or fracture anything cause i got strong bones but doesnt mean it dont hurt -- my neck has been killing me ever since.

Muscle pain is one of the more often used reasons for insurance payments, you can easily claim it based on whiplash, etc.

I didn't realize yours was an 07, I kept thinking it was older than mine lol.

4 years, but technically still going

Waiting for a person to parallel park, was hit in the rear by a cab.

Other person was at fault, had witnesses, including person who was parallel parking who was also hit.

To be honest, I dont know what the payout was, according to my mom it was so miniscule it wasn't worth keeping, so she donated the money to the Cancer Society.
To this day wont tell me how much cause it would probably **** me off.

Main reason I asked if you broke anything was because one of the main reasons it took so long was because she didnt break anything. Even with documented damage to knee cartilage, whiplash, etc. the "value" is debatable. One of the huge differences in the situations is that your car is worth about 15k more than ours was. (95 Camry). but nonetheless, the medical payout varies, so work it as best you can.

Thanks for the information.

Update:

My insurance company finally read the police report and the agent was in shock when she read it(I dont think they believed i was not at fault) and told me to call his insurance ASAP

Thats what i did and this dude didnt even open up a claim on his insurance (Strike one) trying to fix his car himself but he would be the type of stupid ***** to put plastic and tape on it and still drive people around.

My lawyers and my insurance and already gun ho on this (Strike two) and we will be getting on it ASAP and his insurance cant say **** cause they didnt know they have no idea what happened cause he didnt even report it.

When i called to make a claim yesterday and sent in the fax the lady on the phone was in shock that the guy admitted to the police he ran the stop sign (strike three) and the claims (adjuster suppose to call me today)

Looking pretty good to me -- first thing im gonna say is where the **** is my rental! lol

In my first accident, I was sitting in an intersection waiting to turn left, when an SUV doing ~60 in a 25 got airborne due to the rise in the road entering the intersection and landed on my hood. The insurance company agreed that the cop screwed it up bad and went after their insurance company for reimbursement. My ticket was dismissed since it was clearly wrong.


So yes, they want to take it as a rule, but it still isn't an end-all. Don't let yourself get screwed by an inattentive cop writing the report.

Crazy right? -- ALSO how my ******* car is getting pushed around places -- ******* sports car and classics DONT EVEN have my car!!

Way too much to explain but from the first shop the car went to sports cars and classic then all of sudden it is at some broadway collision inc hack shop -- crazy bad reviews talking about bad/patches work, fraud, insurance check fraud, stealing parts, crazy ****!

You have the right to pick your bodyshop of choice. That is it.
If the body shop doesn't mutually want you there they have to tell you before releasing the car and you can take it to where YOU want it.
Some shady **** is going on.

And if they do repairs without you approving, then obviously you don't have to pay them. The insurance company needs you to approve who they send the money to.

Yea....i live RIGHT UP the block from there.
I HATE finding parking on my block thats why i always park on 4side or something -- its crazy with the hospital and all the people that work around here there be NO spots!

That hack shop hasn't touched my car and i called them this morning and gave them a peice of my mind -- str8 up told the dude why the **** you got my car in your chop shop -- 2 much to explain about my convo with him cause its mostly curse words and him saying he dont want any trouble from my insurance lol -- the towing company i think tried to scam me and took my car to some hack shop -- i gave my lawyer the towing company information so both those spots got something coming to them.

My car is now being taken to the right shop.

**** is crazy what people would do to get money -- I guess dumb people would let that slide and not know whats going on but NOT ME!!!!!!!!

I love my baby 2 much for that
