Bad Guy MazdaManiac - STILL

I paid 760$ for a Cobb AP on the 16th of September 2008 and I got nothing. Its now the 24th August 2009 and I have not received any tracking numbers from him, or any response to pm's or emails I sent him.

I did one mistake. After month without getting anything I wrote him I've wrecked my car (my car feels wonderful) and want the money because I thougt, ok, he never sent it (never got any tracking number from him) so he can just give me my money back and everthing will be ok.

Now, everyone here is thinking I'm not telling the truth, got my AP and just want my money back because I wrecked the car. Again, I've never wrecked it, I just wrote it hoping to get my money back this way because I NEVER got my AP.

MM did and is doing nothing. He has to show me that he really shipped my AP. I want to see the tracking number for my package. MM, just post it here in this thread.

I can verify I paid it, now you have to verify you've sent it!!!

Kazuma.

neXib 08-24-2009 01:22 PM

And you couldn't say this in the existing thread because...?

This is why people are having a difficult time believing you... because you already lied once.
If you would have been honest from the beginning, things might have worked out better for you.

When I first ordered my AP I ran into a financial situation.
I wrote Jeff asking him if he could refund me because of my situation.
He wrote me back saying, "no problem" and even gave me kind words wishing me well with my situation (first time he actually showed a heart towards me ;))

All I'm getting at is I hope you learn from this and realize that you'll get more in life if you are honest with people.
I hope you and Jeff can work something out and I don't think its unreasonable for you to ask for a tracking number.
Hopefully Jeff can simply post it up and lay this to rest.

.

I had exactly the same thing happen and I asked him to refund me for the 3071 turbo upgrade he had made up for me . He did so without any fuss and I was most gratefull . Still like to give him sh*t about other stuff but from this experience I know he is someone I would trust .

DarthRX8 08-24-2009 05:56 PM

MM is a lot of things but a thief..... C'mon.

He has bent over backwards for me countless times during the tuning process. If you really want to work this out I would try an email to him personally.

Again, I really don't understand why it's soooo difficult for him to send me the tracking number. Should be no problem if my AP was sent, think about it.

Just because MM is thinking he really shipped it doesn't mean he really did it. Everyone can lose sometimes!!! I think that's the case...

bse50 08-25-2009 02:00 AM

I doubt that he would forget about shipping. He orders the APs individually and then ships them.
You should have asked the tracking number immediately anyway, not after months!

I did so but never recieved one!!!

bse50 08-25-2009 03:47 AM

Sorry to hear that, i thought that you just came up after a long time saying that you didn't receive it. My fault.
I'm sorry for this whole situation too since you don't actually know who to blame without having a tracking number in your hands. I know for sure that MazdaManiac would not screw somebody but mistakes do happen. Whether it is on his side or on the shipping company is a mystery then.

Something to notice and that might help you is that Jeff has been screwed by some "smart" users in the past so always reminding him that you're not attacking in any way could speed things up.

This is why I want the tracking number. I want to show the people here and MM that I never recieved the AP! But he is doing nothing! Why should I tell him to provide the tracking number here in this thread if I recieved it, think about it...
I don't understand why he is doing nothing. That isn't the way you should handle your customers!

bse50 08-25-2009 03:59 AM

Jeff should definitely provide some proof but i'm not his or your lawyer so i really can't do much and i usually hate being in this kind of threads.
I started posting here because of a misread so now i really don't have much to say.

rx 8speciale 08-25-2009 04:19 AM

basically hes blowing you off for lying to him but if you didnt receive your AP and he dont wanna pay back or show proof of shipping ,he is stealing your money. i will get in contact with him and try to resolve good or eventually get a lawyer

dillsrotary 08-25-2009 07:50 AM

I agree. MM's input is missing. I'm sure there's a decent explaination for this. Everyone will be happy sharing tea and crumpetts together eventually.

I wasn't referring to MM's input, but I get the feeling that we are not seeing the entire story.

Oh yes, I still agree with you.

Kazuma 08-25-2009 09:48 AM

It is the entire story! I've paid the AP and never got an AP or a tracking number! It's that simple!

Rynrx8 08-25-2009 09:59 AM

Well if you paid, I don't care what the excuse is you should get your item. I would ruin his name the same way you are if I got put in this spot. However, this isn't the entire story and we need to hear both sides of it.

Kazuma 08-25-2009 10:08 AM

I don't want to ruin his name or something. I just want to find out with him what was going on...! I don't say that MM is lying, only that something went very wrong and I think the tracking number is the key!

MazdaManiac 08-25-2009 10:13 AM

You paid.
I shipped your AP.
You received your tracking number immediately. (You didn't receive a "shipped" notice from Google because I do that manually and I wasn't using that feature back then.)
Then, months later - after I had already received your delivery confirmation and you received your AccessPORT - you destroyed your car and were suddenly needing money and figured you would scam me for the AP.

I don't have access to the old paper receipts for items I shipped last year and were received. After I get a confirmation that the item is delivered, I box that stuff up. When my living situation changed at the beginning of the year, I destroyed most of last year's old paperwork. I simply had no need for the stuff - everyone had confirmed receipt.

You, just like everybody else, have a serialized AccessPORT. There is no mistake - your unit was shipped.

I'm not going to simply hand you $700 dollars because you want to hold me over a barrel.

Kazuma 08-25-2009 10:17 AM

But I never recieved one! You HAVE TO VERIFY you shipped it! You cannot just say I don't have the paperwork anymore!

You say you've sent it and I say I've never got one. So we have the same position. I can verify I paid but you can't verify you shipped it...think about it!

Which was the company you sent the APs with???

I verified it - LAST YEAR.

Sure, it would be a good idea to protect myself against fraudulent customers such as yourself, but everyone that has received one of these units has enrolled in the Calibration Service and left a paper-trail a mile wide.
You were different. You and I had an open line of communication about "your" turbo kit for months. I trusted you. (Which is a whole other story - want to talk about the payment I never received for your turbo upgrade kit that you ordered? How many "I'm going to the bank today" was I supposed to endure before I accept that you weren't actually going to pay for it?)
At the time, I had no reason to believe you were going to try this on me. I was mistaken.

So, yes - I have no way to verify this transaction now, a year later.
But at that time, you received your unit, I verified it for you with the USPS tracking number and delivery confirmation and that was that.

Its a shame that you are going to hang me out here on a hook just to scam me out of $700, but I guess I am just going to have to endure that at this point.

I'm closing in on 500 units shipped. Every single "complaint" I've received so far - all 4 - has been either a customer error or a scammer such as yourself.

NO YOU DIDN'T! AGAIN! I've never recieved any tracking number from you. I have ask you several times by mail an in the AP thread!!! The turbo is another story, that's right. But we're talking about something I have paid for - th AP!

After you lied, and admitted it, it's a stretch to believe you waited a year for an AP.

Your credibility is shot and you don't have a figurative leg to stand on.

AFAIK, MM has never ripped anyone off, and your case is so weak that, for me, that record stands unblemished.

Give it up, it's getting old....

Wait! Whoa! My reading comprehension must really be going down the toilet.

You didn't wreck your car, Mo? You just said that in hopes of getting money out of me?

Holy crap. I didn't even catch that. Thanks, Stealth.

You have to verify it was SHIPPED & RECIEVED.

I've explained why I wrote I've wrecked my car - I want to start this thread with all info.

No, I don't think you are understanding this.

I don't "have to" verify anything. I'm telling you how it is gonna be.
The fact is, you waited too long to perpetrate this scam for you to have any real teeth.
And simply trying to make me "look bad" here on the forum is of little value. I'm already perceived as an asshole around here, anyway. Its part of my charm.

I'm still stunned that, in the midst of trying to further this scam, you admitted that your claim:

Hey Jeff,
please send the money back...I've had an accident this morning :(...I could cry all day long :(......................
was a lie!

Nothing new, like I wrote in the first post of this thread that is was a lie! I went this way because I was hoping to get my money back this way because I've never recieved anything from you and thought you didn't sent it yet!
Yes you have to, because you have nothing that verifies you've ever shipped anything - I have!

neXib 08-25-2009 11:14 AM

OP: This is just silly. Even if you paid, and something went wrong on MM's side so he didn't send it (even though he's sure he did), you piss all over your case because you lied to him about a crash instead of just saying "If you haven't sent it yet I'd like to cancel my order". That's the stupidest action I've seen in a long time.

MazdaManiac 08-25-2009 11:15 AM

No, I don't. Because you have no recourse. Possession is 9/10 of the law and you can't charge-back on me after 3 months past the original transaction date.
If you really wanted to perpetrate this properly, you would have done it immediately.
Of course, I would have still had the confirmation at that point, so it wouldn't have worked then, either.

So, this is all just an intellectual exercise.

laythor 08-25-2009 11:21 AM

This is the dumbest scam ever. I think the OP needs to move to Nigeria for awhile and see how the big boys do it.

I think everyone is being kinda hard on the OP without reading the entire thread. Looks to me like he has tried to stay in contact and has had vague response. Makes sense to me that if he wrecked his car and no longer needed it shipped to him that he would just ask for the money back instead.

StealthTL 08-25-2009 12:56 PM

Again, I've never wrecked it, I just wrote it hoping to get my money back this way

.....without reading the entire thread?

S

RIWWP 08-25-2009 12:58 PM

Has there been any consideration to the idea that (other than the OP's original lie of wrecking), both sides might be telling the truth? Lost in shipment, stolen off the front porch, accidental typo in the address, etc...

Unlikely, but possible, especially considering the distance and change of countries, etc...

THX. That's what I've tried to say. Perhaps with the wrong words but my english isn't the best! Why should I ask for the tracking number to provide it here in this thread or some time ago in the other one where everybody can check it if I know I recieved the AP. This makes no sence!
I just want to work out what happened to find a solution. If it was shipped it has to be somewhere. All I can say is that I never got my AP...Perhaps Jeff can speak with UPS or something like this...

not really possible since you have to pay customs duty (unless it was send as a low value gift or something)

here's an example of usps monitoring service of a package sent to EU:

Detailed Results:

Delivered Abroad, August 18, 2009, 11:50 am, POLAND
Attempted Delivery Abroad, August 17, 2009, 6:30 pm, POLAND

Arrival
Electronic Shipping Info Received, August 06, 2009

RIWWP 08-25-2009 01:44 PM

I'm not defending either side. Just trying to note that if the package was shipped, and was delivered to his doorstep while he was at work, and someone stole it from his porch (or a delivery driver stole it, or the truck crashed in the river and was swept away, address had a typo but was still valid like a different number on the same street, etc...), then MM would be 100% truthful in saying he shipped it, and the OP would be 100% truthful in saying he never received it.

I admit is isn't common, but certainly possible. It's happened to me, and one of the constant headaches I deal with at work involves situations just like this. The financial responsibility would still be on the OP, not on MM, and the OP still heavily damaged his reputation by lying about the wreck, but both parties could be telling the truth. That email chain could be faked up of course, but each side certainly is putting forth a fair amount of work backing up their stories, so...just saying.

I'd say in either case, if the recipient didn't sign for it, the responsibility would lie with the shipping company in this case.

No matter the case, I think these threads have gone far enough. A year after the fact is not the time to argue it.

MM says that he only got rid of old paperwork from _confirmed_ shipped items though, or that's what I understood.

They might both be telling the truth, but lies doesn't help. And I remember Kazuma asking in the other thread, but that's from March 2009, I think I'd ask a bit sooner if I ordered an AP in September.

dude mm is a standup guy, lately there have been alot of buyers trying to be smart asses with not just mm but other forum vendor's, and with each other its sad to see all this bullshit

i agree it took a long time for a claim.but i dont understand why mm didnt send the shipping confirmation number when the op start asking for it. next time buy from another seller like fluid = good service for what i read.

The fact is that i can vouch in, in that regard, for dozens of italians that rely on his tuning service and sale program.
Problems do happen, let's make it clear, but Jeff managed to solve serious issues here even with his usual long waits.
We often forget individual cases and try to make a general conclusion from bad situations imho.
I don't know who is to blame here and i sincerely don't care.
