I got a problem...... (not with the car)

Ok so I traded in my mazda3 when I got my RX-8. this was on 5/27/06.
Still to today the dealer has not payed off the mazda 3 as in the contract.
I've left many many messages at the mazda dealer that were never returned. I went in and talked to people, still nothing. They kept saying dont worrie dont worrie we have 45 days to do it. I went in on thurseday last week and bitched.. they said the sent the check with the wrong amount and we resend it that day............ (sounds like freaking B.s.)
So here I am today, the car isn't payed off yet, if it's not payed off by the 26th before midnight my credit gets a mark on it.

This is with Mazda credit. I call them and they claim they cant do anything about it. It's still some how gonna be my fault that this POS dealer doesnt take care of its bills.

I'm gonna go down to the dealer and choak the bitch that hasn't returned my calls or payed off my car if this happens...........................

Sorry to hear about your problem.

You could make a payment and then the dealer would have to send a check for the difference because the bottom line would have changed.

If you have a contract on a specific date that your car should be paid off and it doesnt happen then sue for damages.

Yea but why should I make a payment on a car I dont have or own...

I'm not the type of person that wants to have to sue... but, credit record last my whole life and if it becomes screwd up then I must.

This dealer has been nothing but a joke from day one. They cant seem to do anything right. Maybe I'll spend the next few weekends in a lawn chair infront of the dealer holding a sign that says "Ask me how Kendal mazda screwed me over".

It is the end of the month and all, right when they need those deals.

Dude they did the same thing to me when I got my RX-8. But I called the guy Finance and he fixed it real quick. You should try that.

Dude, your credit record doesn't last your whole life. You've been imbibing too much of that "permanent record" kool-aid from high school. If my credit record lasted my whole life I wouldn't own the 8, the condo, the ridiculous amount of plastic in my wallet.

Plus, you signed a contract. If they screw up and you find a mark on your credit history it's very easy (okay, not as easy as ACQUIRING credit) to fix it. Relax, it's summer buddy and you're getting an 8! Don't be "choking bitches"; you're watching too many of yer crazy music videos! CHILL OUT and enjoy your relatively fresh credit report. Believe me, it's gonna pick up a few scabs someday. And scabs eventually fall off.

If they are on a long strip and the dealer next to them is a competitor talk to their manager and ask him if you could put a lawn chair and a cooler on his property right next to that dealer haha.. be hilarious..

But on a serious note look through your papers and see if a exact date is mentioned on when it should be paid off. If none is found go to your local news channel and talk to their "fraud" person. Nothing says get your *** in gear than a news crew asking the manager "how come his car hasnt been paid off.. it says here in the paper work you would.....?!" hehe.. But if all else they might point you in the direction of someone who can help ya out. My mother did this unknown to me when I bought my 8 (she hates the fact I own it haha), she wanted to get me outa the contract for her.

Have you called your loan company on the Mazda3 yet? And told them what is happening?
Tell them the date you traded in your car, and signed the title over to the dealership.
Tell them you can FAX them a copy of the dates on the contracts if they want.
Like was mentioned before you could make a payment on the 3 and they will send you a check for any overage. Might take a month to get the money back but it will come back.
And if it does ding your credit it is easy enough to dispute it on-line,,, Well kinda.
Go to the dealer and say you want a check number, the amount of the check, and when it was mailed for your records ,so if you do get dinged on your credit you have proof.
Also mention that you will be calling the State AG (Attorney General) right after you leave.
That will get their attention.

It just really pisses me off that they never called me back once. I've even explained the whole thing slow and clear on the answering mechine of the lady that pays off the car... Only to go in and find she didnt do it...
I guess I'll head that way tomarrow and try to get check information.
Then I 'll ask for a copy of the contract that i guess they forgot to give me..

It won't go on your credit as it's a Mazda swap.

Just to make sure you call the loan person and tell them what you did as mentioned in previous post.

So you're saying you want a ding on your credit report for failure to pay because of a dumbass Mazda dealership? I'd be pretty pissed about that- doesn't it stay on there for 3 years, at least?

Trekk, call again today, and if nothing happens, you should take them to small claims court, or whatever court would have jurisdiction. Too bad it's not two weeks ago, you could have sent them a letter demanding payment via certified maill, and that would 1) let them know you're serious and 2) give you proof that you tried to rectify the situation before it became a problem. It's really easy to ding your credit, and not so easy to get it removed after the fact.
