Got a ticket, not speeding =)... need your opinions
Hey fellow Canadians,
I got a ticket a little more than a week ago, i made a prohibited(4pm-6pm) right turn on a stop sign. Got caught along with a few other cars. Didnt even know about it at all... guilty?.. yes.. i was wrong, innocent?.. yes!!!
I am going to fight it for sure, its $110, and 2 points. Do you guys have any opinions on anything that'll increase the chance I win? or just share your court/ticket experience. Its my first ticket
and I am not very familiar with the court/ticket stuff. Or you think that I should just pay the fine (not likely!).
any help would be appreciated. thanks!
p.s. i only disobeyed the 4-6 part. not disobeying the stop sign, did stop fully. oh, it was 5:45pm too!!!when i got the ticket.

In Vancouver, the cop who gave the ticket has to show up in court. Otherwise, your ticket is thrown out.
When I was fighting my ticket, I appeared on first day that they scheduled for me. It appears as if they schedule all of the disputes for that one officer on the same day. I've heard from other people that they've postponed the hearing and then the cop didn't show up.
So here's my theory:
The first scheduled date they give you is a convenient time for them. And the cop would've had 10 disputes on the same day in the same courtroom.
However, if you postpone it, maybe the courts won't be able to schedule as many disputes for that one cop on the same day... So... the cop might only have your 1 dispute... and so he might get lazy and not show up.
I think that's your best bet... I'm afraid that if you argue about the time, then they might ask why you didn't show the officer your clock at the time of the offense...

Getting the thing post-poned is a pain. It just means you have to come back later. If you have to cut work or take a day off to go to this sort of thing, that's even more cost. Time is money... I'd pay the ticket and take the earned wisdom and move forward.
