fighting a ticket in ontario

ON fighting a ticket in ontario

Well I got a stupid failure to display 2 plates ticket as my front is on the dash and has been for the past 2.5 years....Anyways I noticed that the cop didnt write out my full birth date, just wrote the year

Does this mean since he didn't jump all the hoops I can get off?

I've heard of tickets not properly filled out getting thrown out, my only issue now is that I'll have to miss a day of work for a 110$ ticket.

You could also argue the plate was displayed in the window. The worst thing that could happen is you pay the fine and miss the pay from work.

I don't think that's considered a major error for it to be thrown out.
Just mount the plate properly and you won't get this ticket.

i would find out if there are any other concequences to having this ticket on your record (ie, inurance premium increase or anything stupid like that). if not, just grow up and pay it. you knew the law. you chose to do somethign different. you finally got caught. my time isnt worth much, but to take a day off work for a 110 dollar ticket....i definitly would just pay it and mount the plate back on. I actually just recently mounted mine back on, and i think im gonna leave it there. good luck with whatever you do.

All the officer has to do is correct the information and initial it. It won't get thrown out, I tried that once. Maybe I should put my front plate back on.

No, it will not get thrown out. It's called a (Latin for) "on the face" error, which is not an error about the facts of the case.

BUT, there is away to get out of it - it worked for me.

Go to the JP for a pre-trial hearing. Ask him/her to show you the part of the HTA which defines "...plates affixed in the prescribed manner..."

I'll bet he/she cannot find it either! Then how the heck are you/we general public supposed to know?

As rotarygreg said, if there aren't any consequences in terms of insurance gains or whatever if the ticket does go through, then I'd pay the ticket. Missing a day of work to go to court for a $110 doesn't seem too worth it, $110 isn't a small amount, but it's not big enough to the point where I'd miss a day of work for it, especially since it's not guaranteed that you'll even get the ticket revoked and the charges dropped.
