Actually, if they "saw" your plates on the road ...while dragging (which, of course, is not something you do) but hypothetically, and were prepared to give a statement to that effect, then it's a problem. Likewise a photo, revealing your number plate attached to a car, would be even more persuasive.

As to 'publishing' a photo containing a number plate, my understanding is this may be contrary to the National Privacy Principle in the case of the ISP or other 'publisher'.

That's why you generally see them obscured on television broadcasts around a specific incident.

It's pretty rare for a citizen's report of an alleged speeding offence to be taken seriously by the police. Lay witness estimates of speed are notoriously unreliable. Further, a still photo is not generally going to reveal a speeding offence. Might be a bit different if they get some video (or perhaps a still) of you doing something obviously illegal like running a red light or stop sign. But I don't see what this has got to do with the issue of posting pictures of cars showing plates in a forum. It's not like you can drive without plates, so if you're doing something silly and someone gets some objective evidence of it, then yes, you might get into some bother.

As for the contention that publishing a photo containing a number plate breaches some kind of privacy legislation, I doubt that would be the case. If the photo is taken in a public place, such as a public road, I'd suggest it's fair game unless you can point to something specific. Never heard of the NPP you speak of but it sounds more like a guideline or code of conduct rather than a binding law.

Plates are usually obscured around a specific incident by the media to safeguard the publisher against potential defamation allegations.

I can understand some people wanting to remain anonymous in a car forum for whatever reason (and such wishes should generally be respected if they're made known) but as far as I am aware, there's nothing illegal about posting pictures that reveal the plate.

It is the first time (prob) that I agree with Revolver with his reasonings

I guess the rego plate is the property of the VicRoads/RTA etc. So it is a public property - not yours.

 

i n NSW, you pay for the "right to display" the plates on your car annually.... (not too sure about Vic and other states) and in NSW, you dont own the lawn in front of your house, yet you are responsible to look after it....

NPP is delegated legislation. It is not binding, but large corporations must adhere to the minimums set out by the NPP - most have higher demands on the corporation then the NPP.

NPP does not bind private citizens, but is applied where corporations are harvesting information which may contain, private, confidential, personal, credit type information.

There is no scope for breach of the NPP against the ISP , because the ISP was not the information gatherer.

Articled Clerkships

I know that NSW has pretty much scrapped Articles in favour of PLT... But i missed out on Articles in Melbourne... for some reason... I graduated with honours in law as well...

So for this year, im doing risk analysis.

I'd like to become a solicitor and do readings at the bar, but no one wants to give me a shot at being an AC. Lto of my friends had trouble getting articles as well.

 

And you can have the right to reserve the plate for life.

Yeah, articles went out a long time ago. Plenty of people work as a law clerk/paralegal while studying part time though. That's how I did it. Got an exemption from the College of Law because I was able to demonstrate enough practical experience. PLT as a more extended program came in after I was admitted.

Congrats on your honours. The problem you and your friends are facing is that so many people have studied law over the past 10-15 years that there's a glut of bottom feeders at the moment.

Never mind, you'll get a shot. In the meantime any experience you get elsewhere will help you.
