Some guy hit me after getting a brand new bumper

Just spent a month waiting to get this new bumper put on.
As I was leaving work, I was at a 4 way stop, I was going straight the other guy was turning left. I stopped at the sign, never saw a car to the left of me. I continued straight then BAM! The cop couldn't determine who was at fault cause we both never saw each other and can't say who was at the stop sign first. Though I did have the right of way if we did get there at the same time. I don't think this man had his head lights on because I would of noticed him due to the fact he would of been right infront of me to the left. I could see why he wouldn't be paying attention to my side of the road. (This took place during night time) I'm pretty pissed off, I really hope his insurance will cover it. I have 1000 deductible. Here's a picture of the damage.

If he wasn't declared at fault, his insurance isn't going to pay for anything.

Kentucky is a no fault state. Officers can't declare fault.

no fault only applies to bodily injury, not property damage.

Just logged on to view your other thread for the first time... this is literally the next thread I clicked on. Sucks when you get something new and it gets ruined... oh well, life sucks sometimes. At least no one was hurt!

Just got an estimate, $2000 that's for insurance pay though. And that's the best auto body shop in town. So I'm sure I could get it cheaper somewhere else.

You can also choose what type of insurance you want, no fault or regular. That still does not change what the cop does though.

In three U.S. states – Kentucky, New Jersey, and Pennsylvania – policyholders are permitted to choose between traditional tort and no-fault recovery regimes. Under such systems, known as “choice” or “optional” no-fault, policyholders must select between “full tort” and “limited tort” (no-fault) options at the time the policy is written or renewed; once the policy terms are set forth an insured may not change his/her mind without rewriting the policy. In both Kentucky and New Jersey, policyholders who do not make an affirmative choice in favor of either full tort or limited tort are assigned the no-fault option by default; whereas in Pennsylvania, the full-tort option is the default.

I honestly don't see his insurance accepting responsibility if neither of you are sure who was there first or who had the right of way. Based on your description, it's just as likely you are at fault as he is. At least that's how I expect the insurance will treat it.

That definitely sucks though. Hopefully you can get everything back to normal without too much trouble.

Yeah it's going to be too hard to prove. I took it to another place and the said 900 and that's with the price of the wheel. So I guess I'll be picking up some hours.

Similar thing just happened to me last night. Just had the front bumper replaced and painted and a damn deer jumps out in front of me.

I'm now using it as an excuse to get an aftermarket bumper.
