I'll be upgrading from my current 3 series around March and am seriously contemplating the RX-8.

As its a company car, our policy sets out that it must seat 4 adults comfortably. Is this really the case with the RX-8? Does anyone know the leg room in the back, or even a comparision with a current production vehicle?

Any thoughts would be greatly appreciated.

Based on photos I've seen, and from what I've read, yes it does seem to truly fit 4 adults. If you're coming from a 3 series, my educated guess is that it will be at least as roomy (not really that roomy :)) or better.

I think there is will be quite a bit of rear legroom but you really have to see it in real life to make sure.

Mazda said waaaay back at the Detroit auto show (I think) that the RX-8 has more rear legroom than the current Mazda 626. So if the Mazda 626 qualifies, there is no reason the RX-8 shouldn't.
