View Full Version : got a big speeding ticket on saturday

I am 18 and under parents insurance...obviously that will go up. I have liberty mutual...any experience with that?
I was driving a honda odyssy at the time (not my 8) and there was no one on the road except me and the cop. The cop was pacing me and I didn't realize it until it was too late. He says I went 100 and proceeds to give me a ticket stating
100 mph in a 65 mph zone. He also decides to give me a ticket for failing to keep right. I am assuming this is 7 points...maybe 8 at most.
I was in Nj and I am from Delaware. How will this all fare out? He didn't give me amounts and told me to call the number and that I might have to go to court.
Also, the place I got pulled over is about 60miles away from home....what can I do about this?
The statute codes he wrote down are really bad handwriting and I can't find anything about the speeding one.
the failure to keep right is 39:4-88 (the four looks like a 7 too but I could only find codes with 4 and it worked out)
the speeding is very badly written. It says 19:9-12b. the second 9 is badly written but it is mostly a 9 or perhaps a very badly written 4. the b could be a 5 or bad 3

Out of state violations are capped at 2 points on a NJ license... not sure about DE.
Get a lawyer. It will be well worth it.

If those tickets stick he WILL be dropped from his parents insurance. There was a reason the cop gave you a ticket for 100 and not the standard 75/85. Everything up to and including 99mph is a standard traffic violation. 100+ is a whole new ballgame.
Insurance companies will usually treat a driver of your age with a 100+ ticket the same as they treat a drunk driver.

- Tell your parents ASAP! Last thing you want is to procrastinate because it'll only piss them off even MORE
- Get a NJ traffic lawyer, you're going to need it to save yourself from HUGE fines

That was my sister's ticket for 85 in a 65 in NJ. She went to court and I think wound up paying half that.
NJ has expensive tickets. 65 mph zones in NJ are DOUBLE FINES. I would not be surprised to see you looking at a $1000 speeding ticket. I've never actually gotten a speeding ticket in my home state but I have a couple minor out of state ones. NJ speeding tickets can be very expensive. 60 miles is driveable so you are going to want to get a lawyer and go to court. Even if you just get it knocked down a touch, it'll pay for the lawyer in the long haul. Given that it's a pacing ticket for dead on 100, you should be able to get it bumped down. I don't see signs in NJ for keep right except to pass and it's not usually something they really police. He was just piling something on because you are 18 and flagrantly speeding.
So, get a lawyer, go to court, eat a huge fine if you can decrease the points and effect on your insurance (reclassifying the ticket), and don't drive 100 mph unless you can eventually afford to lose your license.

Count on $500+ for a good lawyer.
But that will pay for itself in insurance savings if you can plea bargain it to a non-points ticket.
Get a lawyer for sure. Hopefully you can get your ticket reduced to 80MPH or even lower (hugh differences in fine/points). Good luck... You'll need it.

Not much to fight when they pace you. Its your word against his (the court will side with him). The only thing you can hope for is if his speedo hasnt been calibrated recently. Most likely it has been though, but its something to contest. Good luck!
maxxdamigz 04-30-2007, 03:07 PM I'm not really familiar with pacing in NJ. Speeding tickets aren't very tough to give out in NJ so any cop who has picked up a radar gun has probably written enough tickets to lose interest in it.
80 vs. 100 is a huge difference. 80 in a 65 in NJ is probably in the 200-300 range (because of the double penalty). 100 is a crap ton more and I think the Judge gets to personally kick you in the nuts. I could see a cop writing a pacing ticket for 85 if you were actually doing 80, but 100? That's not even close. When doing 100, you'll pass a car doing 80 at what is roughly the equivalent of running full out if you run fast.
In NJ, failure to keep right is 2 pts and 30+ over the speed limit is 5 points. Being out of state, you get 2 pts per moving violation, but that's still 4 pts (you have 2 tickets).

if that is the case..then wouldn't it be easier for my lawyer to make something happen versus a ticket gotten by a radar
I also have a q regarding auto insurance. since I will be going off to college instate and won't need a car..can I be taken off for 2-4 years and then get it later.
but what about driving....if I am not on the insurance plan..can I still drive the cars (limited though)?
8at18 04-30-2007, 04:42 PM ok for one how do you not know how fast you were going. You should always know about how fast you are going, especially in a mini van. Suv's and minvans don't do to well at those speeds and you can tell. I don't know why all these people are lying to you and trying to make you think that you arent totally screwed. I'm just being honest man i have been to court for a speeding ticket and they know their shit. The judge or magistrate is always going to be on the police officers side to. Good luck just hope and pray you don't have to give up your license. That totally sucks. Your insurance will hit the ceiling to. especially since you drive an rx-8. Whoo your in some deep shit.

gonnahanvan8 05-02-2007, 08:32 AM Most likely what will happen is your insurance will be canceled and you parents will be placed on high risk state insurance. Which is way expensive for almost no coverage. If there is a bank lien on the van, then the bank has the right to demand it be paid off if it's not covered under full insurance, which state plpd is not. Don't forget about the defensive driving classes you will prolly have to take too. Those are expensive. Get an attorney.
