Yes, a clogged cat will rob serious power from your engine.
Check with HiFlight for cheap non-OEM cat options. Most cheap cats will not last under our heat, however he has had success with one brand. Alternatively you can get a used cat on here from time to time.
Driving on a clogged cat will lead to O2 sensor failure, engine damage, and in the extreme a car fire from the glowing cat igniting the bottom of the car.
Don't forget about the 80,000 mile federal warranty on the cat (if you are still within that) or this:

If that 400 miles is within the 90 days, there should be some recourse in CA law for the dealer that you bought it from to have it fixed.

When a car is sold, who is responsible for the inspection?
The seller is required to provide the buyer with a valid smog inspection certification at the time of the sale or transfer. Smog certifications are good for 90 days from the date of issuance.
The inspection is not required on a transfer if a biennial smog certification was submitted to DMV within 90 days prior to the vehicle transfer date (a vehicle inspection report may be required for proof of certification).

Yep, better find someone who is selling theirs with low mileage if you are due for SMOG. Otherwise, like j9fd3s have numerously mentioned before, you will fail if you have close to at least 80,000 miles in it.
