Newly Rebuilt Transmission Doing Same Thing

Problem type: 2nd and 3rd Gear Transmission.
When: Cold Weather and Even after fully warmed up.
Hi
I have a 2005 RX8 with 35,000 miles on it.
Background
I had bought the car in slightly warm weather and had the car looked over from a few of my friends and mechanics. I know very little about the rotary as I previously owned a 2001 Prelude.

The problem first arriavied in the cold weather even if the car was fully warmed up. It had problems wanting to fully shift into 2nd gear and would grab while shifting into 3rd gear. I get grinds in both gears if i dont shift it a certain way.

I ended up taking my car to bountiful mazda because the OREM mazda closed down. After about 3 weeks with out my car i picked it up a few days ago.. It shifted fine on the drive home. I got back to provo and was noticing a slight whine in the transmission, I called mazda of bountiful and they guy told me that was normal.

After giving it a few days the whine is gone but i still have the problem of the transmission grabbing in 2nd gear and 3rd gear and grinding if not shifting a certain way.

This was after they overhauled the transmission i still have the same problem.
The overhauled came to a total of like 2,800 dollars... Im wondering if this is just normal or if i should change my transmission fluid to a sycro mesh ??

Any help thanks
