Grrrr!!!!! Transmission problem and bad service now!

Well, I had an appointment to drop my car off this morning where they were supposedly going to tear the transmission apart to look further into my problem as the new fluid has not fully resolved my problem (gee, no kidding). After spending 1 hour 45 minutes driving there going no more than 10 mph on the freeway because of heavy traffic and snowing, they tell me the tech will have to verify my concern AGAIN before they can do anything else for me. Interesting, considering I was told that they would change the fluid first and if I had the problem happen again to bring it back and they would open up the transmission. Apparently that's not what they are going to do now! The first few times I drove it, it shifted better than it had, but not good with 2nd gear (it still feels like it is hitting up against something so that it is "trapped" and can't go into gear or out). Then on Friday I had the same problem again, except more severe than I've had it before. It was nearly impossible to force out of first gear, refused second altogether, and then was stuck in neutral until I came to a complete stop and shifted through all the gears (it made a popping sound) a few times and then started driving again, where upon it barely came out of first, refused second again until being forced on another try. When I did this it let out a loud clunk/crunch sound. All the other gears still shift perfectly. I noticed again yesterday that until the car is extremely warmed up, I still cannot downshift into first until the car comes to a dead stop, and even sometimes after it is fully. It just will not go in, even with force (I'm told this is normal, which I know is pure BS). I'm getting so fed up!!!! The service manager told me that if they could not verify my concern AGAIN they will not do anything and they will not look into the issue anymore as they have already looked numerous times and found "no problems" and that I'm just complaining about a nonissue for no reason!!!! WTF??????!!!!!!

At about 3 o'clock I got a voicemail on my cell phone (it's beyond me why they never call my house number as my cell phone rarely works at my house). It was from a man at Ron Tonkin who says he's the head of the service department and that he's been driving my car around a few times since I dropped it off trying to verify the problem, but it won't do it for him (why was he driving it around in all of this snow for one thing, and secondly, why is he doing it when the car is good and hot, which is when I said it shifts mostly okay?). He wanted to know the details of what it was doing, how, when, et cetera so he could have a better idea of what the problem is. I called back to talk to him and got a voicemail, where it states that he is the head of dealer operations, not the service department. Odd, I think?????? I left him a message clearly outlining exactly what the issue is, when it happens, and what it does when there is a problem, including the fact that my transmission has a strange whine in it consistently since changing the fluid, whereas it was only occasional before. I told him all the same shifting problems are still there, just a little less frequent with the new fluid.

Why do they have to verify the problem yet again when it hadn't even been two weeks since they discovered the problem before I called to make another appointment, and after they did "step one" to fix it, which didn't work, especially considering they said they'd tear it apart if it continued when I picked it up last time?

Secondly, how can they tell me they will no longer look at any complaints of transmission issues if they don't find something wrong this time? I still have a warranty good for at least another year mileage wise and they have verified an issue with it very recently (heck, the tech couldn't get it in or out of gear when they first "verified" the problem)? That doesn't sound right.
