Code P2070

I just purchased an 04 RX8 with a 2 year warranty that covers everything but wear and tear, will something like the tuning valve being stuck open be considered under warranty. I went to auto zone and they checked it and this is what was listed.
Definition intake manifold tuning valve stuck open bank 1 probable cause.
1. Linkage stuck open or broken
2. Mechanical condition
3. intake manifold tuning valve
I'm not a mechanic so I really do need some help with this I don't won't to pay for it if its under warranty, so if anyone can help it would be appreciated.

Use that simple search feature for "P2070" and I'm sure you'll find the answer. ;)

Thanks Jon I saw your post I wish I could do that myself like you did in your video but I have limited knowledge on cars, but I would be willing to learn if I could find someone in Dallas to teach me. I hope something like this is covered under my warranty.

If you read my thread, you'll notice that it was created to troubleshoot and narrow down the problem since its not always a stuck valve that causes that code.
What you saw in that video is the "worst case" scenario.

Once I remove the engine cover the switch will be on my left (standing in front of the car) and use a long screwdriver to press down on it and if it moves back in position with no resistance it should be fine? and if it is OK what do you think could be the problem and I am new to driving this kind of car only had it for 3 weeks any suggestions on how to redline while driving to keep the carbon out I get a little nervous but I know these cars are supposed to be pushed. Your knowledge of these cars is a great help I see you help out us RX8 owners a lot, thanks.

Like I said... my thread details the various components that could fail and cause SSV related codes.
Best thing you can do is start troubleshooting each component:
