Dear Mr. Gomez:

This firm has been retained by Milan *******olve a dispute he is having with Mazda over a defective clutch in his 2004 RX8. As you can see by the enclosed invoice that was prepared by ***** of Ferman Mazda, Mr. LeDuc's car only has 7,099 miles on it and is already experiencing problems with his clutch slipping. As you are aware, Mr LeDuc's vehicle is covered by a one year/12,000 mile limited warranty, which covers this clutch defect. Unfortunately, when Mr. LeDuc brought his vehicle to Ferman Mazda to have his clutch repaired, he was advised that his warranty would not cover the required repairs. Apparently Mr. LeDuc is not the only person who has experienced difficulty with the Mazda RX8 clutch. Enclosed you will find copies of numerous complaints from other RX8 owners regarding the same problem.

Please be advised that if Mr. LeDuc's clutch is not repaired free of charge under his limited warranty by Febuary 20, 2005, we will pursue legal action against Ferman Mazda and the Mazda Corporation.

My clutch was repaired on the 17th but is back at the dealer's because it has already broken down again! this time it seems like the carrier bearing they replaced was defective. but i won't know for sure until i get the car back. in the mean time i am driving a Jeep.

Also, the first loaner car the dealer gave me had expired tags and i was pulled over and given a warning. took the car back the next morning and changed vehicles and got a coupon for a free oil change.

If anyone has issues with their clutch let me know. i will mail you copies of all the docs i have. but you might have to get your own attorney's letter.

Too bad it had to come to that. You are now either going to be treated like gold at that dealer, or you'll be made to feel unwelcome with an endless stream of subtle "accidental" screwups and oversights. It's already not sounding good. I'd get the clutch dealt with and then take my service needs elsewhere.

update....i have my car back again. the dealer replaced the transmission under warranty but blamed me for it failing. i have already put the break in mileage on the tranny and am going to schedule a fuid change with them soon. the new tranny is much better then the first one. although i have noted rubbing noises especially in first and reverse. i will mention it to them and make sure they put it into their computer. i learned my lesson from the clutch not getting complaints documented. but so far all is good!

how bad was the clutch really slipping? Im experienceing something close to it, but have no idea if it is slipping. When i let go of my pedal I have to have it depressed a little over halfway to have the clutch grab. Is that normal or is it supposed to be closer to the floor ?

In mine its not close the floor. Its engaged almost at the fully depressed point

The clutch bolts are coming loose.
I just removed an engine and when I went to remove the clutch pressure plate the bolts came off with very little effort, this engine had about 8K miles on it.

some people had problems with the bolts not being torqued properly.

if you thing your clutch is slipping, try to go in a higher gear from a stop. if it stalls right away it is fine.

my new transmission makes rubbing noises! i am going to have my mechanic look at it before i take in to the dealer. that way i know if i am getting the run-a-round.

by the time i got it fixed i could only use first through third. and at high rpms
