This document directly from the EPA outlines what situations it is legal to use an aftermarket catalytic converter such as Random Tech's cat that is being developed. Please read this to make sure you know what you're getting yourself into.

Rx8 owner: Hi, I need to replace my stock cat with a new one
Shop: Well, you can’t do that since your car is so new
Rx8 owner: Well, my stock one was damaged, so I need a after market one
Shop: Really, damaged, how’d that happen?
Rx8 owner: it was terrible, I was working on my exhaust and accidentally punched a hole in it.
Shop: That’s too bad, may I suggest a high flow one?
Rx8 owner: sure, I’m really going to miss my old one though

I understand the law about changing your cat, but the way I see it, if I need a way to have higher exhaust temps, I would rather continue to save the environment rather than running a cat-delete pipe. I am willing to make alittle more effort and pay alittle more money to keep the air cleaner.

I think the issue here is using a higher flow cat, rather than deleting it.

Edit: Just saw your car's specs - and you already have one.
