Well,

My RX8 was hit pretty bad last Thursday but I just decided to post this today as I am feeling a bit better! I was rear ended by a Jeep Durango that made me hit a F250 truck with a towing device that was in front of me.... Needless to say, I still see visions of the air bags deploying, exploded rear window fragments all over the cabin and smoke getting inside. A scary moment to say the least! I don't think he even hit the brakes. My car is blue so no silver curse. lol

I am ok. A bit of neck and back pain and I hope this is not serious. I went to the ER on Friday and I have to wear a brace neck for now. MRI results were OK but they still want to keep me under observation.

I am very very sad about my loss but at the same time I am thankful the RX8 protected me the way it did. It gave his life to protect me. The trunk is pretty much gone, the left side pillar are bent, bumper is gone, taillights gone, rear window exploded and the cabin is full of fragments. In the front, the hood is bent, bumper is gone, headlights are gone and radiator is destroyed., airabgs deployed (This is just my first assesment since I haven't looked at the car again)

I guess it'll cost too much to fix it and I am sure it'll never be the same...especially the way I had it setup.

I don't know how to claim all the aftermarket stuff. The guy that hit me took all the responsibility and said that he'll pay for everything. Of course, I was rear ended so he knows this can get ugly.

His ins company is Farmers Insurance. I just opened a claim with my own insurance to see if this helps out the process.

I just want to know how to claim this as a total loss. I don't want any body shop welding and fixing the frame back. No way it'll be the same again not to say the big depreciation my car will have after this.

Any advice?

Sorry to hear of your accident. Fortunately, it sounds like you were not hurt seriously.

It definitely sounds like your 8 is totalled and the insurance payout will be calculated as such. I don't think that you'll have to worry about fighting this point.

You may have to fight for the modifications to be included. Hopefully you have some receipts if the amount the insurance gives you does not cover the current value.

So what car are you going to replace the 8 with? MS 3 or 6?

Would be interested in the pics that you post. Curious to see how the 8 fared in the accident.

Get a lawyer. They will handle all the legal matters and net you money for your injuries. "Pain and suffering" inconvenience,lost wages, etc., etc. Give the lawyer additonal items list that was installed on the car and they will fight for you. It will not cost you any of your own money. You will be better off in the long term with an attorney.
Insurance companies will try to settle for an amount in their best interest.

These are just a couple of pics taken that day. I should have taken one from the rear left where it shows the rear pillar bent.

Looking at the RX8 sturtural data, the frame is definitely bent in this crash.

Let's see what happens...If they fix it, can I request a MS body kit?

if ur frame is bent, there's a good chance you'll be totalled. I dunno the rules where you are but where I am it only takes 75% of the value of the car to do it.

You can always pick up an 04 or 05 and put the MS kit on that :)

I love the way these cars look after a wreak. It makes me feel safe to know they can take a hit and not crush like a cardboard box.

There isn't a frame. It's a unibody. It's definitely tweaked a bit.

I am sorry about your lost. Glad you are ok. I gone through the same thing except I was hit head on. My front end was trashed somewhat worse then yours. It was determined totaled. I am thinking yours should be totaled as well. Bought a E90 330i 4 door. 8 months later, sold the bimmer and now a proud owner of 06 RX8 once again. Just missed it too much and had to get it back again.

ummm... that's interesting...

I thought the center black plastic piece on the rear bumper is part of bumper, that's why people can't just buy the piece... but the way the picture shows... it looks like it is hanging and is detachable....

The big pieces, yes. If you talk to the shop guy, you may can take some small parts off here and there behind the scenes.

I had a car totalled and they let me take all my stereo stuff out of it.

At this point still no word from the other guy's insurance. I went to the place where they have my 8 and took a couple more pics...sad sad...

I already told my insurance that the only place I'll take my car will be the dealer.

Now Farmers is being "a little slow" in contacting the guy that hit me.... go figure...

this doesnt look to be totaled from the pictures .. look under the car for evidence of bending the frame somewhere .. so far i only see body work and maybe some engine trunk stuff that needs to replaced .. dude break some headlamps, windshield etc .. to bring up the value of your loss .. just kidding .. but if the value of repairs is too low you may end up with fixer

farmers should be pretty good about payouts, but you really should be coordinating everythign through your insurance

whatever farmers programs are dont really apply to you because youre not their customer you didnt sign the contract with them so i wouldnt count on the total new replacement or whats it called

the depraciation you're talking about is called diminished value .. quick search gave me this

aftermarket parts installed on the car are usually covered if you can prove purchase (have receipts) though all of them will be valued at 50% or less because of depreciation

see some doctors, take some time off from work - sounds like a big enough hit that you can milk this - not that im recommending that you do this but dude you wrote yourself "i'm posting now that I feel better" - ok if i had to say that, that sob (sob's ins) would be paying

Ok now, you have the upper hand since that moron rear end you. So if I were you, I would be first contact the insurance company, of which you already did, but what you should do is to bitch at the insurance company said that its fuxking ridiculous to rear end my ass like that blah blah blah. get the car to a shop and tell them to give ya a report of the car being totalled. The reason is that, when a person gets rear ended, the uniframe structure by design would transfer most of the force to the front to minimize the frame damage, but you got rear end and you hit the car in front of you, that means the force somewhat bounce back and didnt go anywhere. So I dont think you want to sit in your 8 anymore (after the incident) no matter how you love it. Its just not safe.

Take whatever you have (aftermarket parts) out of your 8 and keep it. claim it total. Then you should tell your insurance that you will go find a lawyer and sue the dude who rear ended you. His insurnace would work with your lawyer AND your insurance company. sue him for physcial(body) and mental(hehe...)damage. but you would need to be friendly to your doctor so he can write a *good* report*

depends on how much libilitiy he has on his durango. You should be able to get at least 10-20 K out of his insurance company alone, and this does not include your 8's totalled cost. which should add up to at least 50K or more. Their insurance company will try to drag this process, yep all insurance companies do that to get you annoy so you stop the claim, dont get annoyed. keep fighting it until you're happy with the price they offer (be reasonable, tho) but expect this to take around a year or so.

Just remember do NOT say anything to their insurnace company, they will try their best to make it your fault. but be honest to your lawyer about that you want to sue him for damage, most lawyers would be MORE than happy to do it for you (if you're going to find one), they will take 33% of your claim, just so you know.
