its happened before. i think kel rx8's car was up for sale on ebay, but located in a completely different state

i wouldnt mind that, it just means that my car is nice enough that other people want to have it. that Yellow looks amazing too.

yea saw this last week can't really do much about it. Emailed them politely to take it off didn't work I guess. Whatever just as long as they're not scamming people I guess it's okay.

like i said your car is hot enough to put it on a site to impress people so they buy stuff, i would be sending emails askin for a cut of the earnings and thanks to them, your car is famous....

^^ haha thanks, that's an optimistic way in looking at it but I really doubt they're going to give me a cut of anything.

They appear to be an actual business (note I did say appear)! If you scroll down to the bottom of the page there is a box saying "See More Great Items From This Seller" in which they show several other styles of rims that they are selling! So maybe they just saw a great looking car and figured that this car is a great example and could help move units! Hopefully this is what is happening!

btw...You can add another to the bandwagon IZoomZoomI, your car does look great!

I'm glad you're not my lawyer. Just because something is on a public website doesn't mean that copyright doesn't exist. Just ask the RIAA.

So IZoom, you technically could file a lawsuit against them but it generally wouldn't be worth it for something like this. It is kinda lame that they're using your picture but it's not really harming you in this case.

This is correct. From FindLaw.com:

"It is important to remember that information which is freely available over the Internet does not mean that the copyright in this material is lost. Copyright exists the moment the work is created and fixed in a form that is perceptible either directly or with the aid of a machine or device such as a computer. However, to effectively protect such work with the right to bring a lawsuit for infringement, registration is required." Copyright © 2000 by Shaw Pittman.

The site also mentions that you need not be registered before the event occurs. So anybody who posts original work on the Internet is protected by copyright law.

Um.. Report them to Ebay state you've sent them email(s) asking to take the picture of "YOUR" car down with no responce. If anything email them again and threaten to file a law suite if you dont get anything in return.. a free set of rims or I dunno a group discount for Rx8club members hehe...

But as others have stated if all else take it as a compliment.. could be worse you could be a "Before" picture!

Ok I just clicked on the Ebay link to check out the picture.. at first when I read the post from the Op I thought it was just a quick shot of the car. But its actually 2 shots of the car and they are clearly using them as promotional tools. Be different to me atleast if it was just One shot and well a average one at that. Those photo's of your car man are AWSOME btw.. I'd look into some form of protection for yourself and your car.
