Hit by an uninsured motorist today..........

Well, as I was sitting in my 8 this evening while it was still light, 5:30 to be exact. The woman in front of me at the drive through window of the store I was at just puts her car in reverse and slams her car ( 1995 Chevy cavalier) into my front nose. After about 15 minutes the very fist-deep size ding in the plastic nose had disappeared except for a nice rounded and creased mark. She also broke the black grill. No insurance. My insurance will pay, but I am wondering what else behind the nose could be damaged?? Engine parts? actual steel bumper? It's obviuos that the whole front nose will have to be replaced, but I wonder about the rest............. I am going to insist on genuine Mazda replacement parts and I wonder if the nose comes pre-painted?? Anyone else get reverse slammed like me and find out there was more damage than meets the eye??????

TeamRX8 07-19-2005 07:56 PM

the appraiser at the dealership will check all that out

I hope the cops at least ticketed her for not having insurance

army_rx8 07-19-2005 08:00 PM

^no kidding that is messed up driving (badily i might add) with out insurence :(

behind the front bumper is your fvad...some styrofoam..and then a steal (aluminum?) girder type thing that is behind the styrofoam..most likly it isn't damaged b/c from teh sound of it she didn't hit you that hard to hit that (about 6-8 inches in from the out side of the bumper).

i woudln't worry all you need is a new nose...and the body shop at your dealership will square you away.

sorry to hear about your 8 getting a broken nose :(

Killerking1964 07-19-2005 08:05 PM

no ticket issued to her

Due to the fact that it occured on private property, the cops are not allowed to give a ticket or a fine. He did, however, tell her that he'll be looking for her tomorrow and she'd better have insurance then. He gave her a VERY STIFF talking to about her not having insurance since it's mandatory in TN.

army_rx8 07-19-2005 08:07 PM

wow..bad luck again..hopfully she either gets insurence (hopfully) or get s a ticket..your rates can't be raised for uninsured motorist hitting you can it? i hope not..i wanna say no but i'm not to sure.

Killerking1964 07-19-2005 08:15 PM

Because she was at fault and is uninsured my insurance co. will not raise my ins. They will just pay for my car to be fixed and sue her for their money.

What is your deductable? How much is this going to cost you?

:D

Mmmm... Judge Judy action....

But that seriously sucks that you were inconvienced by this stupid driver. You should sue her for your deductable that you will have to pay. I'm sure small claims court would award it to you.

No cost to me. It is covered under the uninsured motorists plan with no deductable.

staticlag 07-19-2005 08:42 PM

Nice

army_rx8 07-19-2005 08:45 PM

^indeed...but a annouying inconvience :o

dsmdriver 07-19-2005 09:16 PM

You only pay a deductible on cars when it's your fault. The deduction is for "collision" and "comprehensive" (damage to the car when not moving) but they treat an uninsured motorist claim under different coverage. I've never seen a deductable for UIM coverage.

merdy05 07-19-2005 11:23 PM

That totally sucks about your car... i really hope the cop finds her tomorrow and gives her a ticket, people that are stupid enough not to know that their car is in reverse and not drive should not be on the road-thats my opinion. good luck on getting your car fixed!

Too bad the cop didn't just pull out of the drivethrough onto the road and wait for her to drive out

Why didn't the cop just wait for her to drive out onto the street? She has to leave the fast-food property sometime... ;)

UIM will also cover you for hit'n'run either while you are driving or if the car is parked. In these instances, you will have to pay a deductible ($200 in Virginia) because the guilty party is not known. If you pay the deductible and the culprit is later identified to the insurance company, you will get your money back. My Elvira was a victim of a hit'n'run while parked. $1000 in damage but only $200 out of my pocket. Neither UIM or Comprehensive claims affect your premiums and do not count as 'at fault' accidents. Another point is that UIM allows for rental coverage while your car is being repaired, even if you do not have that coverage under your collision policy.

 I hate it that I only know all these details from having experienced them on numerous occasions! UIM invoked 7 times in 5 years. Unknown perp 5 times. :(

L8APEX 07-20-2005 03:59 PM

UIM coverage can have a deductible, it just depends on your provider. my wife's car got hit in the mall parking lot, and the person left. so the damage is now our problem. and the deductible is $250. So it just depends on who your provider is. it really sucks, and there is a special place in hell for people like that.

SSJ 909 07-20-2005 05:33 PM

cant u still take her to court to pay for the damage, or atleast cant your insurance company do that? Why should u get stuck with the bill of a moron?

I believe that falls under illegal search and seizure laws unless the officer had probable cause to pull her over after she left the shop. Now, if he caught her speeding 5 minutes later, then he would be perfectly justified in ticketing her for being uninsured. There are laws which prevent officer from pulling people over just to check for a valid license or insurance because these cause major traffic delays and can be construed as harassment.

chrism 07-21-2005 08:54 AM

my wife got hit by an uninsured idiot from behind and we had to pay 500 for the deductible....they are suing him and so far we got 200 of it back and expect the other 300 shortly

I doubt she was going that fast on reverse. I think its all cosmetics. Here is a pic when I removed the front bumper.

Interesting...do all NA models have only one oil cooler, or does it depend on AT vs. MT, then 5MT vs. 6MT?

FoxTypeR 07-21-2005 09:48 AM

I was just about to comment that she had an automatic. Yes, the 4-port engine only has one oil cooler while the 6-port has 2. Also, in North America, the only option with the 4-port engine is an Automatic, there is no 5 speed manual.
