Got hit by a DUI driver

Man, I am so sad right now. I was coming home from work at 12 in the morning and was taking a coworker home. I took the off ramp and came to a stop light and stop there for about 5 to 10 second and the light turn green and proceeded forward. I saw a car coming but he was like about 30 to 50 yard away and thought nothing of it. As I was completing my turn all of a sudden I got smack on my passenger side. The impact knock my car forward about 50 yards and up on the midle divider curb. I found out later it was a young guy in a mid to late 90 honda civic. He got out of the car all mad and was trying to say I ran the red light.
I was completlyg sure my light was green and He kept insisting that I ran a red light. I did want to argue with him any more and it seem like he was in a hurry to get going. He had 2 other people in the car with him. Luckaly a the police cam and they seperated us. They first aske hime some quetion and then they were doing a DUI test on him. I figure they were going to do the same for me,but they didn't. Next thing I know they had hime in handcuff. I didn't even reallize that he was drunk. I guess I was kind of daze for awhile to not notice it. Thank god know one got seriously hurt. Aside from have a sore neck and my passenger was a little ding up. The side air bag pop in his ear and he couldn't hear for awhil. I will go to the doctor tommorow and have them check me out and my passenger. However, the sad part is my beloved Winning Blue RX8 is in pretty bad shape. the front passenger tire is hagging by the brake line, the fender is crush up against the tire, the rear right side sustain some damage and the front bottom is destroy and the car is leaking coollent. Man that suck. I have alway hear terrible story about drunk driver and never figure to be a victom of one. That guys is lucky he didn't hurt anyone really bad.

visitor 01-31-2004 06:07 AM

damn.....glad you're ok, but that other guy is fffffffffffuuuuuuuuuuuuuucccccccckkkkkkkkkkkeeeeee eeeedddddddd.

CCJ 01-31-2004 06:09 AM

Yeah, DUI is the worst. I am glad that no one was injured. Get you neck checked out right away!

takahashi 01-31-2004 06:34 AM

Bad luck p5.... I am sure you are mad at the guy. Forgive him. :p

Hey Qhris... where did you get the Q car?

CCJ 01-31-2004 06:47 AM

Taka - It's not a Q car, but a Radio Shack Zip Zap. More specifically, it's the special edition chromed X-Men RX-8! It goes well with my 17" Powerbook!

CERAMICSEAL 01-31-2004 08:48 AM

zoom, where did this accident take place? What stste are you in?

Rotary Nut 01-31-2004 08:55 AM

Man it is shit like this that just pisses me the f**k off! I'm glad that you and your friend came out, for the most part unscathed.

I hope you take that shit head to to the cleaners, teach the sot a friggin lesson! At least his insurance will take care of you and hey you will be getting a new car hopefuly.

ranger4277 01-31-2004 08:56 AM

Here in Ohio a new law has been passed that forces a DUI offender to wear "special" bright yellow DUI plates on their car (normal is white). Drivers registered with these plates aren't allowed to be driving past 11pm or 12am.. something like that. Plus it warns everybody (when there is time) that they have a history of DUI. Next best thing to forcing them to tattoo DUI on their forehead I suppose.

Glad you are ok zoom, I have known a few people who have died as victims of DUI accidents. Hopefully you won't have any trouble getting your 8 zooming good as new real soon.

winter 01-31-2004 09:06 AM

Glad to hear you're alright! Cars are fixable, people not so much. Crossing my fingers that you find yourself in the driver's seat of an '8 again sometime soon.

FirstSpin 01-31-2004 09:51 AM

Too close for comfort man. Be glad they caught the bastard. I hope he gets sued, loses, does jail time and gets to sleep with "bubba" in the next bunk. That's still too good for him.

I took my car to some in-law types in College Station, Texas and just before we got there, some doofus breezed through a stopsign like it wasn't there. He was heading straight for my passenger side door. I saw it in time to react and I suspect that he did as well. I instinctively gunned it and steered hard right (running from him so to speak). I doubt that would have worked if he hadn't figured out his screw-up and slowed down some himself.

Then the next time I headed to visit the same people, it freaking hailed on my car for five minutes. Small hail, no damage but I was not pleased!!! Next time we take the wife's TransAm.

carnut 01-31-2004 10:10 AM

Glad you're OK. I like that Ohio license plate idea, so everyone knows who the irresponsible drunks are.

alphapenguin 01-31-2004 10:16 AM

i had no idea ohio was doing that. I know people who do this tick me off, but i say sue his ass off. Some a-hole was sueing me for a small rear ending accident in a mall. The guy didnt sue me until 2 years later (right before statute of limitations was up). aside from that
Hopefully you are still ok. Usually the pain doesnt show till the next day.
His insurance will pay for the damages so hopefully you get your 8 fixed soon. best of luck.

Texas 8 01-31-2004 10:29 AM

Glad to hear you and your co-worker were not seriously injured!! I don't know how you resisted the urge to throttle the life outta him....

Shocka 01-31-2004 10:52 AM

glad to hear you are ok.. hopefully u get a new 8 soon and this guy gets his dues.

Outlaws eXtreme 01-31-2004 10:54 AM

The good part out of all this is...

1) You and your passenger safe...

2) You will get your car back, + more money for injury and time loss from work, + more money for his beligerent attitude which made you have a nervous breakdown, + more money for your passenger and his emotional distress, + etc etc...

Which = more money for more mods.

klegg 01-31-2004 12:51 PM

First, thank god you are OK!

Second, post some pixs!

93rdcurrent 01-31-2004 02:01 PM

Klegg you sick bastard. We all want to see pics though and I am glad you made it out safe. Another testiment to how great this cars is. I hope that everything comes out ok. Definately take this guy to the cleaners. I also love the license plate idea. (I never pictured myself saying this but) Go Ohio!

zoomzooomp5 01-31-2004 02:06 PM

Thank you for all your support guy, I 'm a little sore today still. And yes! I will be driving a RX8 again. The car held up pretty good considering the speed he was going. I'm going to looking for a lawyer to help me out and make sure I get compensatted. Be carefull out their. It's a great day here in sunny San Diego and I'm just missing my 8 really bad. She got tow home last night and she park in front and It just hurt to see her in just a bad shape.

zoomzooomp5 01-31-2004 02:07 PM

I will try to get some picture but I need helping posting it.

Baphi 01-31-2004 02:12 PM

Sorry for you, but you seem to be both ok !

Well I am getting worried at all the people in my country getting thu the RED lights and 90% are not even drunk !
Seems that a lot of people are color blind or brainless.

Sunny enough that I might actually wash the car today.

For some reason I thought you were in Ohio - did this happen in San Diego? If so I'd be interested in knowing where...

SpYnalChRd81 01-31-2004 03:41 PM

Thank God everyone was alright!

My friend was driving a nissan altima in the hard rain
and barely stopped behind a car
but another car that was behind him didn't stop
so my friend's car got sandwhiched
He was okay
and he didn't really complain to the other drivers or anything
Just the people in the front car came out going "you stupid mother of @#$%#@$%@#$%#@%#%$%@#%#@$!!!!!!!!!!!"
and suddenly
6 months later
my friend gets slapped with a law suit by the car that was in front
for $100,000 on 5 counts of destruction

1. personal injuries
2. time away from work
3. property damage
4. motor vehicle damage
5. emotional distress

Now, the part I don't understand is the emotional distress. The other party was the one that came out and yelled all over the place.

If that drunkard came out saying "you ran a red light you lying piece of @#$@#% mofo" then I think you have a case.

Post pics!:)

mmmdowning 01-31-2004 04:09 PM

Glad your ok, DUI's make my skin craw. I say to the cleaners for this kid.

zoomzooomp5 01-31-2004 04:25 PM

Hey Qhris... where did you get the Q car?

Well, not likely. DUI penalties, if you aren't aware, are not as harsh as you may think.

GiantXTC 02-01-2004 12:20 AM

Oh that rocks!!! There's something to be said for a little public humiliation in exchange for committing a crime, kind of like the oddball case of a judge sentencing a thief to walk around town wearing a sign saying what they did, etc. Some Florida counties still use chain gangs as "Sheriff's Work Parties" where the prisoners clean up the sides of the roads and highways. Just one catch though - they're wearing black and white striped uniforms with "Prisoner" or some other descriptive of the county on the backs of them.

Sometimes justice does prevail (at least a little). :)

no_pistons 02-01-2004 03:56 PM

it's good to know u are still okay..p5.. take care.

btw, any crash test results for RX8?

kstirman 02-01-2004 04:20 PM

I now have an RX-8, but about 6 weeks ago it was a brand new IS300. . . .

Driving in downtown San Francisco, in my fist new car ever, 4 days old, a woman ran a red light and plowed into my IS300. My wife, mother, and 2 year old son were in the car.

After hitting me, she then proceeded into the street light on the corner. The scariest part of the accident is that where her car found its final resting place, there were a number of pedestrians standing, waiting for the light to change. They jumped out of the way just in time. . . .

Still waiting for all the insurance stuff to settle. No one in my car was injured (sore, but that's all). In her car, it was only the driver, and while she was conscious and not visibly bleeding, she did go to the hospital in an ambulance.

It seems like a dream that I owned that car. It is a great car, and I very much enjoyed the short amount of time we spent together. However, I simply could not resist the temptation of getting a different car, and the 8 was my first choice - I simply didn't think my wife would be able to drive it.

We should all keep our fingers crossed that your car is totalled out. After some negotiation, they did totaly out my IS300

You know, just a couple days ago I was out for dinner with my fiance, and came to a turn to the left. I waited, got my green light (completly stops the oncoming traffic) and started to move out. There where 2 cars already stopped at the light on the farthest left and right lanes. Then this car in the middle lane completly ignores the red light she has, AND my car in the middle of the road and keeps on going. Fortunatly, my wonderfull woman noticed her and I was able to stop JUST in time. She didnt even FLINCH. I called the cops and gave them her tag while we recovered from the freak out.

I hate some people. Hope you get your stuff worked out.

DUI is a criminal offense in Australia.

We hate drunk driver with passion. THere is an ad saying from Traffic accident commission "If you drink and drive, you are a BLOODY IDIOT"

repeated offender have a max sentence of 6 month. SO if PEOPLE from the down under and do that, you will be sorry for yourself and expect a ozzie cop being "very rude" to you.

that's my $0.02

These days they're day-glow orange.

Outlaws eXtreme 02-02-2004 08:05 PM

In Thailand, if you drink and drive, you will have one of your testicles ripped out by a rusty spoon... then when that is over, then the real pain comes...

klegg 02-02-2004 08:11 PM

You know, I am thinking about that, and it works for me.....is that wrong?

Yep - and they can pull you over whenever they like just to give you a blood alcohol breath test. No probable cause or anything else required - you can just randomly be pulled over and asked to "blow in the bag", and get hauled off to jail if you're over the limit which is 0.05%

Certainly makes the "I'm OK so they won't pull me over" theory pretty useless all of a sudden.

*edit* - another Aussie drink-driving slogan "Are you under 05 or under arrest?"

Simon.

Thank you for all your support. I got an estamate from his insurance on saterday and the total so far is 6900 with looking at the under carage of the car which I know took some damage and the egine bay still need to be open up for a full inspection. I will deffenityly try to get a brand new 8 out of this. As for the car during the accident, it help up pretty good. I'm guessing the guy was going atleast 50-60 mph when he hit me.

zoomzooomp5 02-03-2004 01:12 AM

Excuse my spelling, The car held up pretty good and the 6900 was just the estamate for the exterior damage.
