Dealership Overfill

Oh man, I'm extremely pissed at the moment. Took my rx8 to Cush mazda in Escondido on monday to get the first oil change done (normally I do my own, but wanted someone else to get the first filter off).

Filled up my gas tank tonight and decided to check the oil. Turns out the greasemonkeys at the dealership overfilled it. Hard to tell how far in my garage, but past the point where the dipstick thins out. I checked the invoice, and the quantity next to the oil listed is '5'.

Obviously, this isn't as huge of a problem as it would be on a piston engine, but I'm pretty upset that my rx8 with less than 2,000 miles on it has been overfilled for the past 5 days. My questions are as follows:

1. How damaging is this?

2. What should be done?

I'm taking it back to the dealership tomorrow morning to confront them about it, but I'm not going to be satisfied by them just draining the excess oil if it could've caused any damage to my brand new car. Should I call a lawyer?

Owners Manual - Chapter 8, Page 10:

"CAUTION
Don't add engine oil over F. This may cause engine damage"

That oughtta make him feel better. :(

At least any problems would be fixed under warranty.

Got them to drain the excess and write down that they'd overfilled it, so if any problems are caused that should cover my ass.

Hi just wanted to tell you the same event happened with me but I was too lazy to go back to the dealer and just waited till the next oil change which was about 2 weeks later. that was 3 months ago and cars been perfectly okay so it shouldnt have cause u any trouble.

I checked mine less than 2 miles from the dealer when I picked mine up (July 2003), because of the warning in the owners manual (I read it at the dealership), and mine was EXACTLY on the "Full" line, after letting the car fully warm up, cool for 5 minutes, and then checking it (per the procedure in the book).

I doubt that Mazda corporate would overfill them intentionally and then warn about engine damage in the manual........

tpryor made a good point. Make sure the engine is at normal operating temperature. Let the car cool down for 5 minutes and then check oil level. I would have it drained immediately if its overfilled. Better check oil level right there at the dealership after an oil change and drain it if overfilled.
