Lemon Law Car...what to do???
 

I don't think this has been covered, so I didn't do a search (Flame Here). OK, we have that over with. My wife and I bought a 2005 Hummer H2 a year ago (Flame Here) We bought it from a Hummer dealer who bought returned H2s under the California Lemon Law in california. Now, the State of Washington says everything was done properly, except the Washington docsuments were NOT provided me. This vehicle has a "Branded Title". Until I saw the Washington documents, I had no idea what the ramifications of a "Branded Title" was. this title stays with the vehicle and identifies it as a vehicle returned under a lemon law. The stealership is offering my $1000.00 if I sign and send in the documents saying I'm good with this deal.. 64 dollar question. Should I sign or try to get them to take the vehicle back?:uhh: (Flame Here)

Wait... so you knew it was a lemoned vehicle when you bought it?

So you knew it was a certified lemon, but now you don't want it, because of something to do with the title?

Take their $1000 and live with it - I don't think you have any chance they will give you your money back.


....and hurry, Hummer dealerships are going broke daily!

You could try to get your car back but by the time you get your lawyer on the phone Hummer will be out of business, just like Stealth said. You bought that godforsaken gas guzzler at least you can get a months worth of gas out of it.

Blow it up in a couple of weeks and claim insurance - one less H2 in this world.

OK Yes I was aware it had been turned in under the Cal. Lemon Law. I was also provided paperwork about its issues and what was done to repair it. My problem is that the title is branded; further devaluing an already devalued product. Also, it's far too late to get my trade-in back. That was gone in less than a week.

One other thing to remember is that Doug's Mazda in Lynwood, WA is also a Hummer dealer.:lol:

Also a Hummer is to dirt as an RX8 is to pavement, among the best.

If the "documents" were not provided to you, and the dealer is willing to give you a $1000.00. Then that is a sign that there is more money to be had. Obviously they did a No No.
I might consult with an Automotive law attorney and see what they say. Obviously this is something the dealer seems to feel that they need to rectify quickly with a cash settlement. i would dig a little deeper into the law and see what you uncover. Something about total disclosure.

We're talking about dealership here ~ people who work there can sell their moms if the price is right (maybe a bit too much ,but u all get the idea)

There is probably something more that they know but not you, try to dig it a bit deeper.

Ha ha, just knocking you because you asked us to in the original post. I agree with them, the dealer is trying to settle this because they know they f-ed up so could be worth your while to consult an attorney to see what the options are. Unfortunately, you can't trust what the dealer tells you so you probably need to lean on them a bit more to realize what they are trying to get out of or clean up. If at all possible, try to unload it back on them as I wouldn't want to be stuck with a "branded title" hummer as you mentioned and neither would anyone you tried to sell it to further down the road.

I purchased my 2007 RX8 with a Cali Lemon (branded) title with only 7k miles on it. The lemon title was due to radio/security problems and not mechanical. I knew from the begining what I was getting, and that my resale value would be seriously impacted. The upside was I got a 2007 with really low miles for almost 5k off the going price.

I buy cars and drive them until they are darn near worthless anyway. I see a car as a consumeable, and really don't worry about resale.

If you intend to keep the car and drive it until worthless, negotiate hard and get what you can out of them. If you are worried about resale (Hummer+Lemon title= ouchie) you are probably already stuck unless you can get them to back you out of the deal.

Getting backed out of the deal would, for me, be the best thing. I do know the minute I cash that check, I'm toast.

This situation made the local papers, and they reported the Washington Attorney General's office discovered and worked the situation with the dealer. I kind of think the dealer has cut an agreement with the Washington Attorney General on the settlement.

Yeah, I knew I was going to get flamed, H2 and all, but my wife loves the thing. Which, unfortunately, might be the key to the whole situation, giver her the check for a tank of gas! Anyway, I appreciate all the input, and take the digs as earned and in the spirit they were given...where's that friggin' "group hug emoticon?":lol2:
