I thought I would be driving the new 8 this week, but I guess I have to wait a while. My dealer promised me rx-8 Gt/appearance/navigation for 35,500k and I put a thousand down on my pre-order. When I went and picked it up they changed their mind and told me it cost 41k. I went and argue but in the end I went and got my money back. I just can't see my self paying 41k for an rx-8. I know this car is lovely but for 41k thats a little steep.

$41k!!! sheesh! you made the right decision to skip it.
the dealer is out of his/her/its mind. the RX-8 will be a high production car, no price premium required. sure Mazda only made 17,000 this year but there will be more next year, think Miata eh?!
Moogle if your pre-order deposit form lists the agreed-upon purchase price and is signed by all parties, I'd contact Mazda Customer Assistance (800)-222-5500. You can fax a copy of the pre-order to them and they can likely assist, maybe send a rep to have a little "chat" with the dealer principal or refer you to another dealer with the same model who will honor agreements.
Is there any fine print/disclaimer/waiver on the form? They might argue that it's not a valid legal contract, but in good faith they should honor the agreement that you put your money down on.
Don't roll over on them if you still want that car!
What they told me was this paper is to make sure that you would have your car by the time it comes and it wouldn't be sold by no one. This is my 1st time buying/financing a car so I was kind of confuse with the big talk they gave me. I argued that I should be getting what was told, but they said they don't really know till the cars get here and the price they gave me was an estimate.
I am not going to directly say the dealers name because I am not that mean. The zip code of where they belong is around the 92880 though that's all i can say.
While I am already over thingking about what happen can anyone help me where is a good dealer to search around "so-cal." Oh yeah one more thing they told me that since this is a new car "no Mazda dealer would sell it on msrp," that right there kind of stumped me and got me saying nothing after that because its true isn't it?

BS. When the cars came into my dealer ALL cars were msrp. Including non-preorder dealer stock. That dealer you went to is a bunch of bull. Seriously... hope you find what you are looking for and a dealer that treats you with respect.

A friend of mine used to work for a Toyota dealership. Being nice doesn't help you much when negotiating for a car here in so cal. If you are a push over, you will get pushed over, and done in the behind. Stand firm when talking to any salesman, and don't be easily "stumped". Always go to the dealership armed with knowledge of what other people are getting the car for, and most importantly stick to your target deal. Only bugde a small amount (up to $600 pre financing for example). Good job on walking out on that deal. Please slander their name, they deserve it for not honoring their verbal/written agreement with you.
