Strange issue...
Well I just had my engine replaced and now I had a CEL for secondary intake runner and SSV stuck open. Problem is it isn't stuck open, I can physically move them by hand. Sounds like a sensor issue, what do you think?

Paging Jon316G.......party of one!
I'll qoute him here as one example:
"First thing I would check is for pinholes in the actuator... its happen a few times before.
If you have a vacuum pump (like from a brake bleeding kit), disconnect the airline to the actuator and hook the vacuum pump to it.
Give it vacuum (about 10in.Hg) and see if it holds the vacuum.
If you notice the vacuum going down, then you know the actuator has a pinhole".
It could also be the switch as said above in a post. Do a search on Jon's "SSV teaser video" thread there is tons of info in there.

The actuator is fine. Had a problem with it chattering a few months ago...had the engine replaced for a 3rd time under warranty. Dealership says it's not from the install and they will look at it but ofcourse want to charge me for it. They say the problem is probably pre existing and it's my problem not theirs, granted they covered all extra expenses with the engine swap of whatever Mazda didn't cover so, I really am in no position to ask them for more free stuff. I'll check the solenoid though.

If the actuator is fine, I would check the solenoid and impact switch:
Here is a DIY I made for testing the solenoid:
https://www.rx8club.com/series-i-do-yourself-forum-73/diy-test-solenoid-190364/
And this is a post for testing the impact switch:

You might also want to clean the electrical contacts to the solenoid.
You also mentioned it chattered a few months ago, does it still occur or do you just have a CEL?

I called BS...they say the only thing they were liable for was the engine itself since they installed the old parts from the previous engine. I'm gonna try and reason with them tomorrow...
