Received a call from my dealer today suggesting a sell the car back to Mazda instead of arbitration (mine's been in the shop going on two weeks now) for Lemon Law. He says that anoyone who paid over MSRP should receive a full refund but wouldn't guarantee it.

regarding this issue. They are closed, of course, for the weekend. Being that mine is in the shop since 774 miles with no diagnosis, I'll likely opt for the buyout. They won't let me have/trade/keep the loaner RX8...so that's why. Love the car, but since they want the loaner back and can't fix mine, looks like it will be my only option.

Wildwhl, this sounds like the best option (buyback) for you. I don't blame you since your car has been in the shop all this time and the service department can't seem to find out what's wrong. It's a shame though they couldn't just trade you for the red one, since you really loved the RX-8.
Called the RX8 Customer assistance line this morning. They confirmed that, although it will take some paper work and waiting, you will receive your full purchase price back. He did NOT state whether that included taxes but from his comments I would assume so. I informed him of my situation and that I would indeed be opting for the buy back and asked if he could expedite paper work. He said that he does not yet have the paperwork, but should receive it this afternoon and will expedite it to me.
Very polite and nice. His name is Mike. Quite professional and understanding. I wish my case were different, because at any HP# this is still a great car, however, my faith in Mazda lags with this misrepresentation not to mention the fact that they still cannot diagnose what is wrong with my vehicle.

i called the 800 number twice today and was on hold over 45 minutes both times and never got through. tried the voice mail and it said the mail box was full. i just wanted to make sure i'm eligible since i put a deposit on the car and signed a sales contract before 8-26-03 but i'm wondering if i will get the letter when i take delivery sometime in september or before.

Received a call from a Mazda representative (not Mazda, sounds like a legal firm) indicating they had received my paperwork for the buyback. She indicated that I would have to fax her the title before she could "calculate" the amount of my check. I asked her to please explain and basically did not receive an answer. I asked her point blank if people like myself who paid above MSRP would be receiving a refund for the full amount and she avoided the question...so...I'll keep posting, but this sounds like it will not be very fun to handle. I do not even have my title yet and may not for a few more weeks knowing how the state of NV works...
I DO have my car back, so I'm going to drive it and enjoy it while I can :-)

When I got through yesterday, I asked them several different
ways what we would be getting back.
They told me we would be getting the full price back (including
tax, license, etc...) but not any interest or after market parts, etc...
Of course this person sounded more like a nice person who was
just a operator reading what she had been told to as a oppose
to some one who knew all the facts.
