I just failed my MV inspection for of all thing the gas cap. Does anyone know if the gas cap is covered under the warrenty?

If it is a defective part it can be replaced by your dealer "I guess" if it otherwise complicates the function of your car as a whole. Otherwise go to your local automotive store and invest on a $10-30 on a cap. That's that!

So are you saying that this should be covered by the warrenty or that it is kind of like brake pads and tires. Some that wears out and you need to replace.

Am not sure, but you should contact a dealer about this issue, give/show them a copy of your failed MV inspection. It may be a probability of having it replaced.

Failed gas caps is a fairly common occurance with the RX-8 and a dealer will almost certainly replace it under warranty if you show him evidence of why your car failed the emissions test.

i've never heard of a gas cap being considered as a "wear" item for warranty issues, but i guess stranger things have happened.

It's not necessarily a wear problem, rather a faulty, non-sealing cap that allows fuel vapors to escape. Usually, a CEL is thrown when the vapor containment system loses pressure due to a faulty cap. In which case, it is an emissions issue which the dealer (i.e., the manufacturer) is bound to rectify.

Uh, what exactly is wrong with your gas cap? I noticed on the last two fill ups my cap unscrewed more easily than it used to. This time I made sure to screw it back on tight and I'll check it out next time. It doesn't really bother me, though, so I'm just curious.

Everytime I have had any of my cars inspected by their respective dealers while they were under warranty, they passed...
