Ok, so I took my car into the dealership because it made a weird pinging/grinding noise at the top of the first gear. Really bad accleration, and I have a jerkness/pulling while I am driving. They have already replaced my sparkplugs and ran a infinate number of flashes and other bullshit, they also replaced my cat.

After 9 days they finally decided they were gonna replace the fuel pump. They did I got my car back they said the noise was cause because something was not getting enough fuel. :rolleyes:

Ok, So I get my car back and take it up to Grand Bend in Canada. An hour into my drive up north, my Check engine light comes on my tire sensor comes on so I needed gas anyway so I pulled into a gas station to check it out, All 4 tires has 32psi.

I take my car back to the dealership today, tell him what happened and said the only other thing I can do is replace the engine. He told me he will do a couple more tests but he ran all of them the first time when I got my fuel pump replaced. Not really having a choice at this point I told him alright and to get me a rental now I am at work...pissed...with a mazda 6...and waiting to file a lemon law.

Any wise words of advice to help calm me down? :(

i dont understand? you had a problem of some kind for which they replaced your plugs cat and fuel pump. then later you get a CEL and the TPMS light for which you want them to replace the engine? why does it say somehting about lemon law in the thread title?

Lemon laws typically require that the dealership attempt to fix the SAME PROBLEM multiple times with no resolution.

Has your original problem (pinging/grinding, bad acceleration, jerkiness) been resolved? Did you notice any of the problems on your drive to Grand Bend?

A/T or M/T (out of curiosity) ?

Have them check your coil packs too, bad accel and jerkiness can be caused by that..

i've never heard more talk of the lemon law as i have on this site.

Your car doesn't qualify to a lemon law, even if it did it's something that you sign and get a new car...

It involved lawyers and lots of crap you should hope you dont have to go through.

I agree, the way I read it there was a problem that dealer fixed. After a few miles there was another problem, which may or may not be related to the first problem. The dealer is now attempting to fix the second problem, presumably under warranty. I don't understand the problem, the dealer seems to be responding.

lemon law also goes for anytype of fixing that devalues the vehicle. engine replacement its mayor work on the car, which means car value gone to shit. im goin thru that process now.

Lemon Laws vary from state to state.

Loss of value plays a very small issue in some states and none in most.

In Michigan its 4 times to qualify for the lemon law and yes It has been the same problem multiple times. With NO resolution.

I kept all my paper work and they all state the same problem on them this will be my 4th time taking it in for the SAME problem. I still get the pinging/grinding only this time I get everything I got before but my check engine light comes on. Whatever work they are doing to my car is NOT helping.

Right, it's different from state to state. I had a SVT Contour and ended up suing Ford under the lemon law for multiple problems. Not 1 problem 3 times. I ended up getting $5000 under a settlement with them. These are engineering mistakes, not mine. Ford was more interested in mass production than quality.

I previously had a Contour with no problems before. And I wasn't surprised or upset. Why should I be, I walked away with $5000.

Well its offical. My dealership called me earlier today and told me that can't figure it out and they had a couple other people look at it from Mazda. They ordered me a new engine and they told me that they dont think it will fix it either, But he has to do what Mazda tells him. So I don't know but I'm not going to argue with having a new engine either.

This Dealership is by far one of the best I have ever dealt with and have given me NO problems whatever.

If your in the Detroit area, seriously check this place out if you need some work done.

How do I know if I have a "lemon" covered by the Lemon Law?

The consumer may invoke the Lemon Law if:

The new motor vehicle has been subject to repair a total of 4 or more times within 2 years of the date of the first attempt to repair the defect or condition, or

The new motor vehicle is out of service because of repairs for a total of 30 or more days during the manufacturer’s warranty period or the first year, whichever is earlier.
Replacing the engine will be the 4th time for the same problem that they listed in all my paperwork.

and

My car has been in there close to almost a total of 25 days, but I have had my car longer than a year therefore the 2nd set of rules do not apply to me.

By the way I'm not here to argue with anyone, I'm just letting you know what kind of progress I am having.

My engine has finally came in its been 3 weeks exactly since the say they ordered it. He said it should be done in a few days or so, So I will let you know if this finally solves my problem.

in still fighting with mazda to get my rx8 fixed, my lawyer told me to leave it on the shop, they told me they gonna start charging me 55 dollars, whatever... i truly just want my car back, im scared of getting this one fixed thats why im goin for lemon law, its just gonna take long, we all the shit i been tru id never buy a mazda, but this car its the $hit i love everything about it looks, handeling, speed im praying to the Mazda god to get this fixed.

Called my dealership Saturday July 30th right before they closed to see if they even started. I have just been told that the main tech that does all the work on all the cars and has done all the work on my car has just been fired.

WTF!!!

They promised me my car back by the 4th of August. Now I have a new guy who has NO idea, who I am, whats wrong with my car...who knows if he's new or has any experience. Let alone put a new engine in MY baby.

I did however send a letter to Mazda stating whats wrong with my car and told them about all my problems. ( About 2 and a half weeks ago) I sent it registered mail and they signed for my letter and I got the receipt back today. I am calling Mazda first thing Monday morning and going to the dealership.


They have had my car now 37 days...and they have not even started on my car. :mad: :mad: :mad: :mad: :mad: :mad: :mad:

I just got a call from Mazda, 3 weeks after sending my letter in I got a call from one of the represenatives. There going to be buying my car back from me. I just have to fax my sales contract and other various forms of paperwork to the rep and I'll either have a brand new car or all my money back.

Sounds to good to be true, will see though.

I'm new here but have been reading on and off for about 6 months and thought someone could benefit from my expierence.
I bought my RX8 10/04 in MA where I live and had trouble with it from day 1. No need to describe the problems,.. but they were many and constant. I documented my problems in detail and sent a registered letter to both the Dealer and Mazda office in CA. Mazda responded within 5 days to set up an appointment with me. I met with the local Mazda Rep. at the dealer within 3 days and reviewed the issues with him. He was curtiouse, understanding and gave me 2 options. Swap for a New Car or a Full Refund.
I took the "Full Refund", the paperwork took about a month before I turned the car in. The only charge I had against the full refund was $700 for mileage I had put on the car. Funny thing is the car ran almost perfect after they agreed to buy it back. I really liked the 8 and still do, but it had way to many problems. I give Mazda hi marks as to the way they handled it. Based on that, I would not hesitate to buy another Mazda product in the future.
If you want to persue the Lemon Law it must be documented and done with Mazda directly. Don't waste time with the dealer, they can't do anything for you, it must be from Mazda directly.

I don't like any other car though. Would I be a dumbass to take another Rx8, (Stick this time and fully loaded :rolleyes: )

The only other thing I would get is a 05 mustang...Nothing else even looks buyable to me.

You can always buy another 8 if you want, and probably cheaper.
I looked at the 05 Mustang but it didn't do anything for me. The 8 has a unique design that doesn't exist anywhere else. I'm thinking of buying a nice 1970 or so MG-B. It cost's less and I can fix anything that breaks. I have a 56 Willys wagon I restored to showroom condition. It has never had a recall or TSB.

Well she called but I was in a meeting....Bad timing I guess she did leave a very nice message though. She said that Mazda is willing to either repurchase my vehicle or replace it. She did say it would be reaplced with an 05...If that is the case, I do not want an 05, I want an 06 being so close to the end of the ear maybe they will make some modifications to the 06...internally??

If I was willing to get another rx-8 she said she would encourage getting a manual, but didnt say why :confused: (We all know why though)

I left her a message hopefully she calls me back soon.

If you were in my shoes what would you do?

Money or Rx-8 with some good incentives?

If you have trouble with the next 8, I doubt Mazda will give you another shot at the buyback plan. With all the problems they are having with these cars the trade in value is awful. The only way you could trade it in is with a Mazda dealer, and they don't need or want another 8 on their lot, .."that's for sure". Maybe, in the future things will work out. But with all the unsolved issues with the car I wouldn't chance it. The first thing that goes wrong,... and it will, you'll wonder why you put yourself in this position again.

I know,

I finally got to talk to her, If i take the money I will have to pay for any scratches, dents, anything wrong with the car on the exterior. I also have to pay a 1500 fee because of some car usuage...she's like "Its the law"

I am going to probably end up taking another Rx-8, fully loaded and this time a manual. I weighed my options and this is the best for me.

So now I faxed her my loan information so she can come up with figures and stuff about how much I am going to get back from this and...I call her to let her know they are sending it...and she has a new voicemail saying she will be back on the 15th of Aug...SHE WENT ON VACATION!!!!

Well my bank does not do what is called a "Subsitution of Collateral" which means basically I think adding on a loan if its more. I would have to pay the difference up front.

Since a manual is less money to buy It will work out in my favor, I also think I should be compensated for all the time without my car.

Also they are not buying back anything I put on my car, the strakes, clearcorners, front accent, rear fog light, seat covers ...nothing. So I am removing everything I can when my car gets back to MY dealership (They sent it to another dealer ship when they thought they were going to put another engine in it)

I found this out today: They are chargin my $90 to take the stock tires of my DPK motegis rims. I cant do it myself because since they already bought it back I really dont own in anymore, so I can't take it off the property.

Mazda will hear about this Monday morning. This is purebullshit

Take my car away, Ruin my Summer...and charge me for it?

When Mazda bought mine back they wanted to know if I added anything and what it cost. I assumed they asked so thet could reimburse me fot it. Technically, hey haven't bought it back until they have paid you or replaced the car! If they don't have the title, they don't own it. I also negoiated the mileage charge from $1,400 to $700 due to my time spent. They didn't really put up a fight, she also tried telling me it was the law but I challeneged her on it and we split it in 1/2.
Your grief continues like mine did every time I had to deal with the daily issues. That's why i took the money, I couldn't stand the thought of explaining one more problem to the service dept. as i had been fot the 6 months i owned it.

im going thru the same shit right now... im getting $5200 in a settlement but my f**king lemonlaw layer is tryin to take %70 of that.... ooo hell na! now we are sueing her!

Well, I just got off the phone with my Mazda rep

She found me a car in Wisconsion, Fully loaded, Nav, Velocity red red/black leather etc etc (Which is what I wanted)

After I heisitated to agree, she knocked off an additional 1500 Dollars to compensate me for the 2 months I didnt have my car. Also they are paying me for my strakes/exhaust finshers/gas cap/clear corners and seat covers.

They are going to pay for the taxes,transfer fees to get it here and all that other hoo hah. I am hoping to have a lot more luck with this car. So will see.

After I did the math I am getting a very decent deal for a fully loaded Rx-8.

I still havent agreed I told her I would think about it and get back to her tomorrow morning.

I'll let you all know when I actually get this car if I decide to get it.

Sounds like a good deal. Most important of all is you get shed of the lemon you currently own. The upgrade and other concessions really do make it a decent exchange.

So you need to ask yourself ..... "Do I still want to drive and RX-8 after all this?" If you do, then go for it.

Got another update, My car is shecduled to be delivered to my dealership on the 29th of this month. I am so excited!

I got a Red Grand touring package with the appearance package and rotary accent package for 3350 more than the base price of a manual Rx-8.

Ther are also buying muy strakes and exhaust finshers from me, because I am pretty sure there going to be a pain to get off if I even tried.

I am taking my chrome gas cap and my clear corners off and putting the stock parts back on the car to transfer them on my new car.

I'll let you all know when I get it, Then I'll be crusing Michigan once again happy.
