My Fault!!?!?!?!
As some of you may know . The city of Toronto had over 100,000 pot hole repairs this past winter compared to the 60,000 average.
This past winter I hit a pot hole because I had no choice. If I would have change lanes... I would have been under a tracker trailer.
I sent a letter into the ministry of transportation (Feb 12th 2005) because they told me that they would reimburse me for the damages after I called them (new tire, alignment) $450
I didn't get a response for quite some time. It's been 3-4 months ... so I call her and she said that me hitting the pot hole is my own negligence.
She told me that she would send me a letter stating that it was my fault.
I couldn't believe what I was hearing ..... I don't even know how to react now………

In Memphis, the only way you can get reimbursed for pot-hole damage is if you notify the city in writing the existence of said pot-hole.
Then if you run over it, you can prove you notified them by the date on your letter. Obviously, you ran over the pot-hole before they fixed it.
Of course, you have to prove they received the letter. Delivery confirmation, etc.
However, if you notify the city of the pot-hole, then run over it and try to claim the damage, they will refuse to pay. If you take them to court you will be asked why you ran over the pot- hole since you already knew it was there; after all, you did report it to the city.
Case closed.

So I hear you, but we are lucky. Trust me. Anyway, you know the gov't is like Tfal; You can't stick anything on them!

I've never seen potholes in Toronto like they are right now. And it's not just potholes per se...it's all the maintenance covers and drains that seem to sink a couple of inches immediately after they're installed...it's all the newly paved streets that have chunks of them dug up in the first couple of months to perform surgery on infrastructure underneath, then just quickly patched up (eg you really shouldn't have to swerve to avoid a pothole on Avenue Road between Eglinton and Lawrence right now... it was just repaved last summer for God sake !!!!).
I dunno...maybe since I got the 8, I'm just a little more hypersensitive about the potholes...but I think the worst street in town is probably the street I drive on the most...the street that I live on !!!

My cousin damaged two very expensive Volk rims in Montreal last weekend. But I have to agree the 401 has never looked so bad, especially in the east end of the GTA. I spend alot of time on the 407 and hated the concrete initially but this year I am started to change my mind.
And Pete if you are going to sue, I think you only have 6 months to file a statement of claim against a municipality. The clock is ticking.

I have to agree with Shams opinion about Montreal. Toronto is smooth sailing by comparison. As y'all might know, I took Raquel to Montreal last week. Oh my, what horrible roads. It starts the minute you cross the border, and it doesn't seem to matter whether you're on city streets or the highways. (with the exception of one highway that goes partway to Ottawa.....hmmmm I think there might be a clue here)
I'm hoping that Raquel will forgive me someday although it does seem that she's pulling to the left a bit now. Must have that looked at!

I hear you Shamble..... But all it really takes is one hole. I've seen a couple this winter big enough to swallow the entire front end of a car. .....
Thanks for the warning about montreal ..... i'll take my time on getting there....

The 401 is terrible...
I know I have the option to sue.... but to spend $2000 to get $400 back makes no sense.
