Aren't these pics that were posted here before? I wonder if this can be considered "stealing"?

HA! The seller and the current high bidder have feedbacks of "0'. Stupid asses!

I've sent the seller an email asking what percentage I'm getting. The response should be...interesting.

yes it is the same person. i do like this though:

This color is rare because most of the orders are titanium gray or red.

how rare is blue anyway? i thought the green was rare. lots of people are buying blue.

and also:

The reason for giving up my first allocated slot is that my daughter will be going to a college that does not permit cars in their first year

what college does not allow their students a car to drive to college in?? is this common? so the student has to walk to school?

Very common actually. Most colleges that I know of don't allow first-year students to own vehicles.

The seller replied:
OH im sorry. I just did a search and that came up. i will remove the pictures if you would like or if i can ask for permission. Well email me back, im sorry for this. I really am.

My response:
I'm okay with you using them as long as you include a link to rx8forum.com somewhere in the text; those photos were originally taken and posted for the RX-8 enthusiast community, not for commercial use.

We'll see. :)

I like the comment he made in the other thread,

oh no. Im cancelling my automatic order in my other dealership. He already has a buyer all lined up, so everything is peachy with the dealer and me

This auction is contrary to his statement that he cancelled his order. And, obvious that his dealer's "lined-up" buyer back away. I wonder if he is committed to buying this 2nd car. He said before he's not. To his advantage, Nova is $1525 in the black, so far, & as long as the sale is consummated.

As a postscript, the vendor has indeed added the following to the bottom of the ad:
Please visit www.rx8forum.com for future news and insight of the rx8 :)

They can't actually prevent them from owning a vehicle, but they can refuse to sell freshmen parking passes, making it quite difficult/impossible to have the vehicle at school.

Uh, I think he absolutely changed his mind about an automatic and is selling the one he preordered to get an MT. The college thing may have some truth to it, but really, poor Nova is just trying to get an MT, so how about we support his efforts? Better yet, how about somebody buys it if it suites your tastes and timing?

Strange though, he said he got it straight with the dealer in his 6/17 post >here< (http://www.rx8forum.com/showthread.php?s=&threadid=5564) . Must have gone sour afterall.

I gave everyone the option clearly in this forum to take my spot for free. When no one wanted it I saw ebay as helping out with my monthly payments. I know that isnt right to you guys, but 3,000 towards the rx-8 fund is worth the insults from the peanut gallery ;). The dealer's potential buyer fell through, so it was just a pre-ordered rx8 sitting there not having the pleasure of being owned. Since i did not want the automatic anymore, my sister was looking into it, but there is no sense in owning a car when you are not able to drive it.

So, you're selling your ownership to your pre-ordered AT RX-8? That's profit over (in adition to) the earnest money you put down?
Am I right? You have a taker for $3000 + the preorder $?
You go dude!:D

Hi Folks, I am getting ready to post my RX8 for sale on ebay.
I had preordered in February at sticker price.
Since that time I made a deal on the sale of my RX7 to a dealer in Minnesota who was willing to pay close to my price on my low mileage 1993 RX7 27K miles. In addition he offered to sell me a new RX8 for under sticker. A deal too good to pass up.
I am hoping to sell my prebuy and reduce my overall cost on the one RX8 I will keep.
Did the individual who made the deal on ebay ever get paid. I have had both very positive results on ebay as well as bad experiences.
Does anyone know if the dealer on the prebuy has the right to only sell the car to the original purchaser, or is the deal assignable.
Thanks for your help.
I really enjoy this forum, I am looking forward to my RX8, I have owned all three generation RX7's and hope they also come out with a 4th generation.

A "pre-order" is NOT a firm contract. A dealer CAN sell the pre-ordered car to anyone - although, this would be poor business ethics.

Selling "rights" to a pre-order, is a scam. The car belongs to the dealer, not the person making the pre-order.

If you pre-ordered a car and can no longer purchase the car, then just get your deposit back (which should be refundable, if not, that was your mistake).

My $.02 :)

However, I do have a valid contract so I can always purchase the car and resell it to someone. I do not have to title the car to purchase it.
Thanks for your $.02 worth though.

so does the original person who ordered the car have the right to sell that order? cant the dealer have any say? since the original order person said he does not want it cant the dealer sell to whoever he wants? and mark it up, since the original person isnt the person buying even though there is the contract the contract is to sale to the original buyer at a agreed on price, not someone else who was not part of the original agreement? so if someone wins the auction it really isnt guaranteed that he will still get the car, because the dealer can deny it. so does that person get his money back from the auction if the dealer does not want to sell to him??
