Cop pulled me over last night and says he saw from his car I wasn't wearing my seat belt and says he saw me put it on while I was pulling over. Any luck fighting or should I just eat the 50-70 bux.

In Florida, they have to have a primary reason for pulling you over and then they can give you a seatbelt ticket. Like, you were speeding so they pulled you over for that. Then they noticed your seatbelt was not on so they can write you up for that too. I beleive it called a "secondary offense". The law in your area/state may vary.

Yup I was thinking the same. Liked I got pulled over at a check point and the cop saw right there I wasn't wearin my belt so I ate that one.
But last night he says he saw I didn't have my belt on and he was behind me in the right lane. I thought he saw me on my phone and was pulling me over for that.
Any way some one on another site said the same, they can't pull you over for that ,but he said I should check the law anyone know where I can go for that information.

I'll ignore that, cuz it makes no sense arguing w/ someone over the net, but if you don't have anything helpful to say then read another post. It's bad enough I gotta a ticket you gotta insult me too.

I think it would be quite hard to fight it. You were not wearing your seatbelt, not to mention you have a record of not wearing your seatbelt... not gonna help your case at all. The cop's word will win in court. If you were maybe an Eagle Scout, or some recognized outstanding member of society maybe you could swing it. But with prior history of it, its gonna be tough.

Whether or not he had a reason to pull you over is almost moot, since he did pull you over and you didn't have your seatbelt on.

My advice is to pay the ticket. What isnt accounted for with "fighting" a ticket is that if it goes to court, you still have to pay court fees and its most likely gonna take time away from work or just your life.

Pay the $50 and wear yer belt so you wont have to go through this... yet again. :cool:

Well I'm gonna look into a few things first, but getting pulled over for not wearing your belt just irks me. I know it's the law. But was the cop really checking everbody like that.

And what sux is I never used to wear my belt until my buddy crashed my teg last month and totalled it. Since then I always wear my belt. This one time I didn't have it on I get busted. But I might have to go to war on this one though.

You can go to war, but just keep in mind what I said.

You have a record on this particular offense, that alone is almost an insutmountable hurdle.

first I'm gonna try n see if one of my female friends will be kind enough to pay this for me to save me the trouble.
But yeah I'd hate to take it to court lose and pay double .

Of course, you could plead not guilty and just hope the cop doesn't show up on your court date. If they don't show your ticket is automatically thrown out. This has worked for me twice...

Yup someone on another site said the same, but there is that chance they'd show up and since I gave this cop an attitude I 'd think he'd remember this ticket & make a special guest appearance just for me.

I actually tried to use a Pba card I have and we were arguing over where the precinct my friend works at is located.

Sh*t is crazy. One time I ran a light and did a u-turn right in front of the cops and the Pba cards(had a detective one too) got me out of it.
I was talking on the phone(no headset) and had expired plates and they got me out of trouble.

No seat belt -TICKET.

Correct, sort of like a get out of jail card depending on the offense and officer didn't work last night though.

I have afriend that knew the last LA mayor and other RICH important people. When he was pulled over for speeding he just showed all the business cards of the people he knew and the cop just let him go. Dammit he's such a lucky bastard. I wish I knew rich and influential people.

These kinds of things just piss me off... if you decide to break the law, and get caught, suck it up and pay the measley fine. If you have to get a 'woman friend' to pay for it, that's even more pathetic. Just do the responsible thing, pay the fine that you deserved, and get on with your life. A whole lot more responsible than taking up the courts time and a police officers time to drag him into court so you can lie under oath. Come on, you're not a little kid with your hand stuck in the cookie jar... time to grow up a bit...

I'll second that! Could not have said it better... People forget that this kind of irresponsibility costs everybody in the long run.

DAMN! Some of ya'll need to relax, I said I wanted to go to war on the ticket not Iraq.

But I appreciate everyone's response to this thread even if you did'n't agree w/ me(except the guy who said I was retarded and should be spayed and neutered, I didn't really like that).

I have thought about just paying it,but if I beat it or get someone else to pay it I'll have 70 dollars more for my deposit on my Rx-8:D

If I got that ticket, I wouldn't fight it cuz 1) I dont have time 2) $50 or whatever is not worth it.

It's people like you that bring our society down. If you break the law, make a mistake, or don't wear a seatbelt one time, it is still your fault. Take responsibility for your actions. Even if one of your female friends is willing to pay for it, it doesn't mean that you should take advantage of the situation and let them.


Please, I don't think any of us need to relax. One aspect of maturity is being able to acknowledge your shortcomings, so grow up and face the music. It's the least you could do.

Does your car have seat belt force limiters and/or pretensioners? Airbags-front, head, side? Height adjustable anchors?

A simple 3 point seat belt is very archaic. You need a strap over each shoulder that crosses the rib cage. you also need to hold the pelvis in place. Also a crotch strap wouldn't hurt.

Active headrest, got those? helmet/HANS device.

A seat belt is not a panacea for auto safety.

But a seat belt helps to hold you in place, so you can have better car control, and drive harder/faster and safer.

If you can't afford to pay a $50-$70 dollar ticket, how do you expect to afford an RX-8?

Weapon X ignore his rude comment. I say fight it, most of the time the cops wont show up. I won many ticket fights by post-poning as long as possible, next thing you know the cops never show up. Try to get the court date in the morning, I have never lost a ticket case. Though I have never gotten a seat belt ticket, mainly I was going 72 in a 65 mph zone.

One comment though keep your belt on always, dumb law or not keep it safe.
