so I got pulled over for speeding today doing 70 in a 50 zone.

Cop came out of nowhere no headlights nothing no sirens so I see him pull around a car and speed up behind me so I start slowing down. I pull into a parking lot and hes like you know how fast you were going I was like no you tell me officer he says 70 in a 50 i go ok. So next he asks for license and registration and proof of insurance, I give all that but my insurance card is expired so he recognizes this and i tell him that I had just renewed and i havent placed my new insurance card in my vehicle. So he goes back to his car and does his thing comes back and says well I wont be giving you a speeding ticket but I will give you a ticket for not having insurance card.

So quick question is this a easy ticket to win just fight it and show up with my insurance card.

whats the cost of the fine on the ticket? it should be just a fine, no points, and your insurance company wont even car if they see that ticket on your record...it may not even show on your record. what im getting at, is that it might not be worth taking time off to fight in court.

It's a $~100 ticket with no points and doesn't go on your record. Might just want to take it.

In Tulsa, if you take this up to the court clerk with insurance card showing you were covered during that period (within 3 days of the violation), you pay a $30 processing fee and the ticket is dismissed.

In my home town if you come in anytime before the court date with your proof of insurance little lickets like this get thrown out and you dont have to pay for anything

are you serious? and you are all bothererd by this? i mean, my time is virtually worthless, but even i wouldnt waste my time going to court over something as stupid as this. i would just mail off a cheque and chock it up to me being stupid and forgetting to put my up to date insurance slip in my car. after all, thats what the ticket is for, and you are guilty of it. man up. learn your lesson. end of story.

not to rain on the karma parade here, but i read in many forums and was even told by an officer friend that if you show up to court with proof of insurance coverage dated prior to your ticket (meaning you were covered as you said you were at the time of the offence), then the charge is thrown out.... simple matter of taking time off work

yes...i did it just a few weeks ago with no insurance on board as well as an expired drivers license.

all thrown out. cops are just bored...i swear they write tickets in order to win internal contests and quota bonus....and the crooked ones just do it to break your balls constantly.

i would DEFINITELY go to court and get it tossed out. at the very least the experience might get you more comfortable with the court system if you ever have to go back. the first time i went to court was intimidating as hell because they didn't take any bullshit and didn't encourage you to open your mouth, just "everyone who will plead guilty/not guilty stand in this/that line and stfu, boom boom, go pay the cashier, next case". just say your not guilty and show them the proof when they call your name.

go to court i got busted for fail to surrender vehicle permit, fail to produce insurance card, fail to stop for a red light. the cop also told me that he could write me another 2 tickets for speeding and not having my seat belt on but there was no point because i was looking at loosing my licence anyways.i went to court pleaded not guilty to any of the charges.the judge dropped the fail to surrender vehicle permit, fail to produce insurance card and reduced the fail to stop for a red light to disobey a lane light.the judge said the charge will stay on record for one year from the time of the offense.as it has been more than a year between the time of the offense and bringing it to court it will not show on your record forty five dollar fine you are free to go.i said thank you your honour and walked out with a grin from ear to ear.

so my advice is put a suit and tie on go to court and address the judge as your honour and he probably will drop the charge for being respectful to the court and to him and that advice was given to me by the law society of canada and it worked.

meh. If you're tight for cash just fight it. Usually the prosecutor will just ask to see the proof of insurance and will widthdraw the charge. Had that happen to me once before. In most cases if a cop gives you a ticket such as that instead of the speeding charge they're letting you off easy. These kinda tickets almost always get tossed out as long as you can prove that you have the slip.

yoo this happen to me. A cop pulled me over because my rear window wasn't clean so he asked me for my drivers license, ownership, and proof of insurance. I had a photocopy of my insurance and he told me he wanted the original one. i told him i dont have it on me its at home and he said too bad and he gave me a ticket for my insurance. so the next day i went to go file the ticket and they just droped it on the spot, but i had to show them the original copy of the insurance thats about it and i was on my way i didn't had to pay a cent

Incorrect, you almost always will be before a Justice of the Peace in traffic court unless at an appeal where you will be before a Judge.

JPs are not necessarily lawyers and paid significantly less than a Judge. (all Judges were previously lawyers for a minimum of 10 years)

Traffic court is one of the most unfriendly environments you can enter. The criminal court on a murder trial is a much more civil place.

my point is you already got the ticket, so go to court you have nothing to loose.

You don't even have to go to court. Just show up at the administrative office shown on the back of your ticket, ask to speak to a prosecutor, show them the insurance slip and they will drop the charges right then and there. No need to wait for a court date!!
