My boss leased one of those beemers and him and his wife dont even take it out anymore and are in legal action against BMW, since BMW so far has stuck it's head in teh sand about this and is not cooperating with fixing it. I have seen the car open the trunk at 70MPH several times.

wow! not what I'd expect from BMW. Maybe they'd be happier in a new Mazda 6?

I have said before and I'll say again: German firms have to get their QA under control. I love the "feel" of BMW, but the US and Japanese firms are way ahead of them in terms of QA (we understand Italian firms don't have QA). My wife's BMW X5 rear passenger window just fell (clunk) into the door while she was driving, the LCD pixels went crazy, and something is up under acceleration (intermitent hessitation). Good thing the warranty covers everything, but is a pain to get it in. Lack of quality is being compensated by warranty (Wrong business approach). The dealership will not give you a loaner, unless you schedule the app. two weeks in adavance. I don't know, but I expected more out a 60k car.
