Brian (06carbon8) still has a chance to rectify this situation and hopefully this thread will facilitate the right thing being done here. I will try to give short version as this is a story that needs explaining.

2/23/08--I sent Brian $ via Paypal for a front bumper. Part of the deal was he did not have to package the bumper in any way or ship it, all he was to do is drop it off at a nearby freight company (i work for this company and we have a hub near him) and they would take care of it.

Just a day or two after i sent the $ Brian was on the job (part of emergency response team) and was injured due to a car driving up and striking the one from which he was in at the time helping someone else, there is a thread dedicated to explaining the accident and can be found in search.

**EDIT: It has recently been proven that the WHOLE "accident" was a LIE fabricated by this guy in order to decieve, it is proven later on in this thread.**

It wasnt until a few days later that his fiance posted a thread here telling of this accident and that Brian was admitted to hospital (first i was made aware as well). So understandably the sending of the bumper was put off. During the following week she told me that she would go ahead and drop the bumper off due to Brian being in hospital. From the jump i was sympathetic and gave the option of just refunding the $ but she insisted he wanted to honor the agreement. She failed to drop it off on both of the occasions she said she was going to (over time frame of about week and a half). She didnt so much as call me or even email me with an explanation. Even at this point i remained sympathetic for obvious reasons and didnt press the issue. More days passed with no communication/resolution. Brian was out of the hospital i believe on 3/12 (give or take). He never said nor had i heard that he had any serious injuries rendering him unable to walk, talk, see or use his arms by this point. On like 3/14 or 1/15 Brian sends me a text message to my phone saying he would drop off the bumper by Monday (17th) or refund my $. No phone call or anything to discuss it with me, just a simple message stating monday or my $ back. I tried calling him but he didint answer. I text him back and inform him that i'd rather have the bumper and i would call ahead to make sure they were ready at the hub when he got there with the bumper. Monday comes, he doesnt send it. No call/email explaining why. A day later he sends me a PM saying he will "positively" drop it off the upcoming Friday (22nd). Friday comes, he doesnt drop it off. I tried calling him the thurs. night prior (21st), nothing, tried callin him the Friday of, nothing. So, from 2/21 to 2/25 he ignores all my calls/texts/emails/PM's until i finally filed a dispute with paypal. He THEN replies to a pm inquiring about why i filed a dispute and then he says he will pay my money back AND send the bumper. He doesnt say anything about when. Shortly thereafter he sends me another PM telling me he is broke, has no car (his is in shop gettin engine installed) and no cell phone (says him and his girl consolidated to one phone to cut costs and she has it during the day). Mind you, this is the first time he has come clean about any of his reasoning for ignoring me, not refunding my money and not droppin off the bumper. We then set up yet another time (this time on Saturday where he for sure can use his girl's car) for him to drop the bumper off. I try calling him Friday night before to verify everything and he doesnt answer. I then get a text message from him saying he will send it. I text him back telling him to just to call me so we can go over it quickly and he texts me saying he cant (although he can text just fine) and to just tell him what time to drop it off. The time of 10am is agreed upon. The hub there closes at noon. Well, i am busy on Saturday afternoon and at this point i believe this guy will finally send it. This morning i call the hub over there, "he never dropped it off". I couldnt believe it. He didnt so much as write me a text or PM letting me know that he once again he failed, no explanation, not even an excuse. To this very minute on 3/31 Brian has avoided my calls/emails/Pm's. This is the VERY short and sweet version. I have all PM's and emails from this ordeal saved and i did not post them here due to length and how embarrasing some would be for Brian. Should i need to, i will furnish them.

In short, i paid good $ for the bumper. The accident happened and i gave up ample time due to that fact. He went ahead and spent my $ for whatever reason, im sure he needed it, but he never sent my bumper. Not once throghout the whole ordeal has he even attempted to call me to work this out. He has ignored me time and time again and broke his word the same. I told him many times in emails that all he has to do is call me to resolve this and he has beglected to do so. I had no choice but to escalate the paypal dispute to a claim and list him as a bag guy. I think he is under impression that if paypal pays out the claim that we will be square and that he will just ignore me until then......i sure hope thats not how he sees it, cuz it will not end there.

Brian, when u read this, just know i gave you more than plenty warning, u know that. You can still make this right. You had no trouble spending my $, so you should honor your end and send the bumper, all u have to do is drop it off. Or, as you have had this choice from the beginning, refund my $ back to me. Please dont drag this out any longer, i understand u have had alot of misfortune in the past couple months, but it doesnt justify this.

brian was a stand up guy when I dealt with him... hope you guys get this settled because he's a damn good kid.

He seemed like it to me an im sure people who have met him say the same, but in this particular case things just werent handled right and this was a last resort. I take no pleasure in listing him.

I'm currently trying to complete a transaction with 06carbon8 aka Brian. I already paid him for a rear mazdaspeed protege lip via paypal on March 9 2008. He promised to send me a tracking number, said he motor blew so he had problems and would ship it "tomorrow" (March 23rd). He sent that message through email, this forum and mazdas247.com. He never emailed me since and now he's ignoring any messages to his email, paypal, mazdas247.com account, and this forums account.

I would like to finish the transaction but it seems like I'm being ripped off. Seems like hes a pretty good guy on this forum with selling things so I'm confused about this whole situation.

If anyone is interested with any further info and I'd be glad to forward our email conversation to you. Just PM me.

I have ALL his info, address, phone number, ect. That coupled with the fact that i have been an investigator for the past 5 yrs (federal and private sectors), its not like he's gonna drop off the map. Is just matter of time before further actions are taken, im just hoping he comes through before such are warranted. If anyone would like that info, PM me.

I PM'd Brian to let him know that a friend of mine (also co-worker) that works out of the Newark hub has agreed to go to Brian's town and pick the bumper up for me and take it back to the Newark hub and send it to me. Of course im paying his gas $ but hes agreed to take out the time to do it. I saw that Brian was here on the forum at the time i sent it so i know he read it, but he didnt respond. It doesnt get any easier than this, all he has to do is be home at a set date and time and my guy will do all the work. If he declines to do this then i guess we can be assured that he was lying about even having this bumper, or has since sold it to someone else. He has no more excuses now that i hav someone who will pick it up, so.....

I have heard that if its not an ebay transaction and you paid straight out of your bank account (like i did) then you wont get shit back. I guess if u paid with credit card form paypal then you may be able to have ur credit card company take off the charge, i dont know. Not sure how valid this is but i guess we will find out.

How would meeting him for a quick sale allow you to make a judgment on his business practices? I don't know him nor have I done business with him but after reading both sides of the story he was clearly in the wrong and I am glad he rectified the situation.

I would like to say that he hasnt rectified anything with me and never actually contacted me. Also it remains to be seen if he rectified anything with jones. I PM'd him, emailed him and posted here since his last post on this thread and he hasn't messaged me back in any of those forms. Its funny, when he wanted to sell me the rear protege lip he responded to my emails the same day. If I remember I will call him today.

I also have a paypal claim open for this transaction and he has not made any attempt to reply to the messages sent to him through that.

If you call me employing someone from that area to have to actually go to his house and pick up a bumper that is rightfully mine when he was suppose to send it to me over 3 weeks ago rectified, then you got ur heads screwed on the wrong way. The pickup is suppose to go down today, so we will see if he keeps his word to at least be there to give the bumper to my guy. So, until that bumper is in my guys hands, im not counting on antyhing.

There are NO 2 SIDES to these stories, they are clear cut cases of extreme negligence, nothing less. Brian himself will tell you this, as he has admitted to such on numerous PM's to me. I wont post them just because i believe his rep has suffered enough and will continue to feel backlash from this.

IMO I think Brian should just give back the $$$ at this point. If it is spent then just ship or make arrangements for the parts he did business on to get delivered/picked up.

FYI uf you paid via Paypal you are protected through Paypal and if you used a linked credit card through Paypal you are also protected through your credit card provider. If you paid bank/wire transfer or check you can dispute this with the bank directly. In any event unless you handed over money (w/no documentation) then you are covered. If you handed over money or a money order I'm sure you have documentation. With the proper documentation you can file a civil law suit in small claims court. You can be awarded upto $5,000.00. But be prepared to provide documentation to prove what happened. If he doesn't show up you get a default judgment. Now I am not sure if this works in an interstate situation but if anything you may want to look into it.

The Paypal claim closed yesterday (shows right there in paypal email brian) after my guy had to go pick up the damn bumper. Just because Brian SAID he was gonna be there for the transfer, i wasnt gonna withdraw the claim beforehand because he has history of lying to me over and over again, so his word means nothing. When my guy called me and told me he got the bumper, i logged onto paypal and it showed that the claim closed in my favor that very day. And i DID NOT RECIEVE ANY MONEY. Paypal DOES NOT reimburse you simply becuase the claim was decided in your favor. What they do is suck any $ the seller has in their account in effort to use THAT $ to reimburse the buyer. And i paid straight from my bank account, no credit card so i couldnt get a charge back. Paypal sent me a message saying claim was in my favor but due to Brian not having enough $ in his account to reimburse the claim, i dont get shit. The only way i would have gotten any money back is if he had it in there for them to take. It was his dumbass fault for ignoring paypal's emails re: this. Not my responsibility. I told him i would drop the claim when the bumper was secure, he's the one who ran out of time, not me. I wasnt about to withdraw a damn thing until i knew that bumper was comign to me. His fault he waited so long and it so happened the claim closed on his ass. Is out of my hands now.

I got ahold of her via email, she failed twice at shipping the bumper (she inherited the burden in lieu of the accident) when she said she would. I totally didnt mind that at all, she would had been under lot of pressure. I didnt feel the need to further drag her into her man's mess more than she already had so i never again tried to contact her after the first couple weeks.

Well, bout the only thing i DO believe at this point is that he indeed was in a very unfortunate accident, and i extended plenty of options as well as time for recovery. Is hard to believe someone would orchestrate such an outlandish lie just to buy time to honor a few online transactions, but in my line of work i have seen way worse, so, time will tell i guess.

Guess I'll give the story of my transaction with him....

After a few PMs, we came to a deal on his stock rims. I didnt want the tires as they were already worn. He gave me a shipping quote and told me he had the tires removed and they were boxed and ready for shipment, so I sent him payment through PayPal.

A week later I had not heard from him so I filed a dispute through PayPal. A couple days later I got a response from him saying they shipped with FedEx and he would give me a tracking number soon. After a few days of no shipping info, I continued to email him and he once again told me they shipped yesterday (at least a week after he had already told me they had shipped) and he would get the tracking #.

After several days of calling FedEx to see if anything was shipping to me I was continuously told I had no packages coming my way. Finally I got an email from him saying they were at UPS and he had dropped them off that day. He told me they wanted $230 to ship them even though his earlier quote was less than half that. He said they were holding them because he didnt want to pay that much to ship them so I said I want a refund, keep your damn wheels. I get another e-mail telling me they shipped them against his wishes and he wanted me to send him money. Come to find out, he didnt take the tires off, which is why the shipping was so damn high.

I ended up getting them about a month after I paid for them. Since they were in good enough condition and I could get a few miles off the tires I told him I would give him the TPS later as I have no use for them. Yeah I could make money off them and most of you will think I am a moron for not, but I have my reasons.

Now that i think about it, there ARE anomolies with the whole story that dont quite add up, but, whatever this guys rep it squashed beyond repair as it is. Now it is just a matter of doing the right thing and getting the people their parts.

Well, i guess this explains why his "girl" never returned my email message asking what hospital Brian was in. Nor did she or he say anything about the injuries incurred. You would think they would be substantial the way she made the accident sound, as well as his supposedly being in hospital for around 2 weeks. As well as only a few days after "getting out" he is talking about attending local meets? All of those questions remained in back of my mind from the jump but seemed insensitive at the time...........yes, i CAN be sensitive:)

I would like to think that he actually was in an accident just because I always try to think the best of people until they prove otherwise. However he hasn't been contacting me about a sale that I sent him money for about a month ago. So I can't comment for or against him. However I did recieve a PM telling me about him being a complete liar and scam artist from a third party. I don't trust him and I won't until I get the part that I paid him for.

why does it take a month?.....when i sell a part its in the hands of a buyer in 10 days or less in the continental US.....and if it isnt then i always keep in constant contact with the individual.......there is no excuse for that type of behavior and if this is all true then i dont know what to say........

I knew a guy once who behaved just like this. Ended up having severe bipolar depression. One minute everything was fine (ie. "it's in the mail!" or "Ill do it first thing tomorrow!") and the next minute he was absolutely useless and depressed and wouldn't leave the couch for 2-3 days at a time, and had to drop out of college because of it.

From a regular point of view, agreed, this behavior is just not acceptable. But at the same time, we just don't know the whole story.

Well, i got into work today and saw a huge box (my guy did a serious pack job for me)sitting near my office door. After about 15 minutes of getting into the box and cutting through the bubble wrap, there it is, one worthless bumper.

LOL, im at work without my camera so i will have to get my camera and get picks Monday when i get back to work cuz im not even gonna attempt to make a go at repairing this POS, its going into the dumpster out back. It seems to be authentic BUT there appears to had been serious damage done to the upper, middle "mouth" area, with the corners and border of the upper mouth being cracked all to hell. The area just above the mouth that extends down from the hood is covered in bondo, there is a through and through crack about 5 inches long on the upper left hand corner of the mouth. ALong with all the bondo there are countless hairline cracks splintering all which ways. The border is cracked all along the ridge. The entire area where the clear corners would fit on the right side is completely broke off. Its a freakin nightmare. No way this thing came from veilside even close to this condition. It appears some amatuer slapped a ton of bondo on it, didnt bother to sand it out smooth and sprayed a half ass coat of primer on it. There is like a 1 square foot area that looks like cottage cheese was spread over it (very uneven surface) and then painted over with black primer.

On my last ride i bought a REPLICA body kit and it looked way better than this, and even THAT one took a good amount of body work to fit. This one would need a freakin miracle worker.

Brian, I want a full reimbursement. Hell, i will send this POS back to u for NO CHARGE as long as i get reimbursed. Unlike you, my word is one you can count on. If you are thinking you wont pay, just remember, you already have one legal issue going through the courts now, you dont want any more; or your suspension from work will more likely turn into a termination.

^^That explains it!! I never saw those pics till now. So, just imagine some amateur (prob himself) whipping up a bunch of bondo with fiberglass strips, slapping them all over the cracks, then slapping another layer of bondo on top of that, NOT sanding it out smooth and spraying it with black primer. It looks like the nose has a bad case of acne, bumps and uneven spots everywhere. The bigger cracks werent even filled its....its just a disaster. There looks to be an attempt to fix it but it still looks horrid. Do you really believe i would have bought that thing after it was in that bad of shape at one time??? Hell no. Thats not even worth headache of even attempting to repair it. I didnt expect it to be spot on perfection (cuz most kits need SOME work), but i wasnt expecting to get a second hand, wrecked, half ass repaired bumper thats fo sho.

See i NEVER knew it was damaged in the first place. He never mentioned at any point that it had once been damaged or that he had work done to it. He acted as if it were all ship shape and that I was one step ahead because it was already primered black, which i figured would work out for me cuz i have dark color (Nordic G). I even asked about the fitment and he said he had it on his car for a little bit to see how it looked, it fit fine, and then he decided to get ED bumper due to not liking the look of the Vielside. No freakin way he had that on his car. That right corner is also still broke off. I dont see how well he could have mounted that thing.

I was totally mislead from the jump. Not that im surprised, now that we have seen what this kid is capable of, but damn. You should see the pics he sent of it, you cant tell as he angles it certain ways and shoots from just far enough away to hide the flaws. It IS a lil hard to spot with camera shots from 5+ feet away (which is at least where u need to be to fit most of bumper in pic), but as you will see when i get around to taking pics, from the correct angles and distance, its quite obvious. Plus he didnt show the busted right corner in any pics.

Nope i didnt get anything. (i paid straight from my bank account through paypal, i dont have paypal credit account) He has to have enough $ in his account to cover ALL claims. I just recieved an email today from paypal saying that Brian just notifed them that the bumper was picked up and that i have it, looks as if Brian failed to let them know that the bumper was "not as described" and it was damaged all to hell and that he STILL owes the money. I was just notifed today that Paypal wont pay me a dime because i had the bumper picked up and it wasnt shipped by the seller.

So the money he put in there that he thought was to pay my claim, likely paid yours. He has told me he is going to send me money order for the reimbursment so we will see it if that happens or not.

And if you noticed that newspaper article said hes from pennsylvania... and this incident and where he lives is in new jersey. therefore he has a PA permit and is carrying and has the gun in NJ. Another problem! So yeah "charges got dropped" is just another lie hes telling to make himself look better.
