well my 8 is no more :( thanks to a lady that never played "red light green light" as a child.

i was in the left turn lane...had a green arrow (meaning oncoming traffic had a red light)...half way into the turn i see something out of the coner of my eye....so i glance right to see a SUV (mercury montaineer) coming very fast (i'd guess 40ish+ mph)....well i didn't have timeto react (i was going 20ish-25mph)....and next thing i know Blamo.......her front left side (headlight area)..impacts my car right in the middle of the headlights.......big bang parts go everywhere...and my car spins about 250-270 degrees.

well 2 ambulences 1 firetruck and 3 cops show up pretty fast...the police site her with running a red light and causing an accedent. of coarse she says her light was green...but the two witnesses say otherwise.

one witness was behid me and said i had the green. the other witness was on her side of the light and said it was red. so when the police report is out in a few days i'm set with the insurance company..(both me and the other driver have the same insurence). still it sucks...i miss my 8 and i'm not going to geet enough to get anouther one:( awe well :(

Hope you are OK after that..my GOD!! Keep your claim open..forgot how long you can keep it open for any possible injuries that might pop up..your car took the brunt, but I'm sure your body did also after that crash..looking at the damage made me cringe..sorry to hear you won't get another 8..but..if you wait it out..Toyota is coming out with a V6 Supra that looks pretty damn sweet..granted, only 2 seats..

Drivers that suck that bad should be required to make up the difference out of pocket to get the person they ram into the same vehicle. It's just BS that any idiot driver can knock you right out of a car you love.

yea my left hand is a lill messed up have to see a hand specialist..but alll in al not bad.

the airbags work great....didn't hurt when the went off (but we have the new type of srs airbags)...so the car did what it was supposed to do ...i.e. save my life..and it did it great....just wish my poor 8 didn't have to...stupid drivers :(

yea the real kicker is .. teh intake manifold ignition system adn engine were all just replaced. :(.....but i wouldn't want any of that..when i removed my gauges and short shifter...i noticed that teh hole where the shifter comes through was elongated adn bent....from the shock of the impact the tranny went back a couple inches and forward about the same...lol so i don't think any of the drivetrain is good.....maybe the rear diff...the back of the car still looks great :)

Good to hear - it still amazes me to see some of the pics on the board where the 8 is that tough in crashes. Especially the ones like yours where it 8 vs SUV.

Big lesson here - Get witness information, especially at a signal intersection.

Without those witness statements, your insurance & driving record takes a hit.

Wow, that is really painful to see, especially since I have the silver as well! :(

At least it looked like the crumple zone worked as advertised. Front end is smashed, but the passenger area looks pretty much untouched.

That really sucks, sorry you got crushed. I am happy that the car takes a hit like that very well. If that was a honda you'd have a motor in your lap.

GO TO COURT if you get called. Lots of time the victim never shows up and the person caused the wreck gets a slap on the wrist and thats it.

I think the airbags are remarkably effective and don't get as much acclaim as their performance warrants.

Glad to hear you're largely healthy after the crash. I sympathize with the whole experience; I hate head-on crashes - I've shook off 3 major ones and a few minor ones thanks to well engineer cars and more luck than I expected I'd rate.

One other aspect of your thread provoked a question - why not get another RX-8? I don't remember reading about you being dissatisfied. Have you got something else in mind?

^ I was thinking the same thing. Prlly depends on the mileage. If you were fairly low you may be able to grab one of the recently returned leased 8s with the settlement amount - or get close enough that the extra cost is insignificant over a few years payments.

on a side note i have 3 defi gauges, a richard paul short shifter, and a rp supercat that i have no use for now :(.

teh supercat was off the car b/c i took her in and got a new engine...haha only got 2 months out of the new 13b:(

i took the guages adn shortshifter out of the car before the insurence peopel towed her. the short shifter has a lill crake on teh pivot bushing (whatever it's called at eh bottom)..that has been mentioned on this forum by a few others tha thave the same thing..i believe a replacment is avaliable from richard.

the guages are fine (and control unit II)...but all the sensors are still in th ecar...LOL there was no way to get them out b/c everythign was sandwiched together. :(

sniff sniff.


oh and for whoever asked....yes she was on her cell-phone:(

Insurance is supposed to give you what it takes to replace YOUR car. If it doesn't, you have the right to sue both the person who caused the accident and your own insurance company. And you should.

from past experience, you will probably be sore in the next few days. please go see your doctor, as a lot of soft tissue injuries happen and dont show up right away. you can get into physical therapy immediately and ward off a lot of the future pain.

i got rear a long time ago and didnt know i had a dislocated vertebrae in my neck until years later. of course it was too late to sue him and i had to pay all the costs myself.

Try for a MazdaSpeed3 hehe.. might be able to swing a Mazda Loyalty bonus (if they even have one). Or maybe just a normal Mazda 3 dont go the Civic Route man, be like driving a TVR one day and the next driving a Smart Car.

I'm happy your alive and for the most part not hurt (hows the hand feeling?). You went to the ER I hope to get X-Rays. Oh and definatly get a lawyer for pain suffering, I'm thankful I did if not I'd be stuck with over 2k in bills right now after my PiP ran out (now just waiting for a settlement to get the money to pay the doctor off). Oh also since you just had a NEW engine put in mention that to your insurance company since it should increase your value a bit (I'd imagine atleast). Be thankful though that both of you have the same insurance provider though, hopefully means all types of services in regards to cash will be made a bit quicker. I had a check cut for my Truck after my accident within 2 weeks after being told it would take over a month from everyone. The woman who hit me had the same insurance company as me so it worked out.

Hope ya stay around atleast man ;)

Sorry about you problems.
Don't accept a check. Make the insurance company by you a replacement car. If you take this option, they have to get you a replacement in at least as good condition and the same or lower mileage as your existing car. They have access to the auto auctions and can get used cars at a lower cost than we can. Use this option if you want to stay in a RX8 and use your aftermarket parts.

On the bright side . . . at least the car is definately totalled.

We had extensive damage to a brand new Accord (from a neighbor's fallen tree) that was repaired at a cost of $12000. The repair work was top notch, and we were happy with the car for another year. We then had a baby, and traded it in for a mini-van. We went to 4 different dealers and across the board, we were offerred $3000 UNDER the standard trade-in value becuase of the repair history, even though the damage was all cosmetic and the repair work was superb!

I felt like I had taken one up the a$$ all over again.

Army, I agree with those that say dont sign off on that claim. Make sure YOU are alright, espcially it you work with your hands as most do these days even using the computer. AL law is two year statute of limitations, check into it in your state. I recently was popped in the rear, although it went against me since I was backing blindly into a road. I had my car fixed, my damage was minor luckily. I am glad to know you are at least for the most physically ok. I know for a few weeks, I was seriously weirded out backing out anywhere, I had lost my own confidence in my driving ability after almost 30 years, but it gets better. I know you love your 8, and probably more now that she has saved your life. I hope maybe you are able to find another.

That is a YES! have reciepts and documentation ready though to prove/provide to the insurance company. Thankfully I didnt have to get my own since they offered me way more than I even till today can believe. They may hassle you because it was under warrenty and not out of your own pocket but I'd atleast suspect you could argue it would/will adjust the performance resale of the car. Dont bend ova unless like me they offer you more than you'd even imagine. For me they overed me close to a grand over Kelly Blue Book and my truck had over 300k miles on it haha suckers!! :rollingla

hand is still in a half cast....hurts pretty bad if i touch or move it even slightly...sniff sniff...i hope the ligaments are okay..bu ti'm a lill nervouse b/c the er said to see a specialist...guess i'll find out weansday when i go to the orthopedic surgeon.:(

i would get an FD but they are a lot of money in this area....and i'll have to pu ta good amount of money into it.

i'd rather have a car with somekind of warrenty until things in my life are a lill more normal. hehe i don't like surprises........especially if they are suv's barreling at me

i took all the paper work out of my car...so i have documentation o fall the work my dealership did the last 2 months...i also have the paper work from racingbeat about the intake and exhaust that is on my car....i'mno tsure where teh paper is that says i got a mazdaspeed flywheel..but i go tit from my dealership so i hope they keep records. ahhhh such a pain in the butt when you car is demolished :(

Amen to that. A good lawyer will know the answers to all your questions on how to proceed. The value of the car should be reasonably straightforward - blue book retail plus sales tax plus your add-ons. Plus a rental car til you've got wheels again. But an injury really needs expert help - and not just medical.

If you don't have personal connection to a lawyer (family lawyer, one recommended by a good friend, etc.) call the Fairfax County Bar Association, and tell them what you're looking for. They'll give you a short list of lawyers with the right kind of practice.

If you haven't started already, keep a daily journal of your daily suffering. Note any pain in doing your normal everyday things and don't be afraid to be very detailed. It could be anything from "pain/difficulty getting out of bed this morning" to "gradual increase in pain throughout the day, can't walk well". Then provide this journal to your lawyer. It will definitely help in making your case for an appropriate settlement for your pain and suffering.

Keeping a detailed journal of your pain/suffering is a very good idea. Take pictures of your wounds too (bruising, cuts, etc...) - daily as they heal if you have a digital camera and/or don't mind spending the money on film.

lol i'll pass on that...i don't really like too many toyotas...the older mr2's were nice looking....but everyoen i see in teh shop has lots of issues...mostly due to high milage+abuse.

oh well who knows what i'll end up with when this is all done...whatever it is it'll be the best bang for the buck (at least for me)..and have a nice warrenty.

a nice long warrenty. lol

Not really sure what type of purchase aggreement you had on the 8. But you may be able to get a new one by just adding an additional year (or 2) to what you were currently doing, right?

Guess it depends on the value. If you only get enough to pay off the car it's tough to get into something new. But, if this is the case, I have to agree with everyone else. Anyone who tries to make it seem like this was your fault deserves to be sued for all their worth.

But - the kbb on an 04 w/60000 miles, private sale value in *fair condition* (not really sure how the insurance co. figures value on a wreck), with base options was 14+K. So, depending on options on your 8, you're looking at an 11k+ down payment on a brand new 8. New color, new 'new car smell', etc., and you should be able to do smaller monthly payments with that kind of down payment.

It's gotta be worth looking into, at least. GL - especially with the hand.

well i checked Kelley Blue Book (website) and my car is worth a hair over 19k. that's before you add on the revi intake that was crushed...the rev8 exhaust..adn the mazdaspeed flywheel that i put on.

let alone the new engine that had 2k miles on it and the new ignition system, coolant hoses and intake manifold that had about 300 miles on them.

so hopfully usaa doesn't give me the shaft....but i should find out tom. or hopfully the next day.

they still haven't recieved the police report...so i went and got it from the station and faxed it to them. nothing like trying to get the ball rolling. i see the hand specialist tom. and my regular doctor for my side and back in the next few days. hopfuly they compensate me nicely for the work i'm missing :(


oh and my monthly payments were only $247..i put a lot down on my baby the first time.

honestly i'm looking at the 06 sti......nice crash ratings (i have a very big eye out for crash ratings and safty features)...can get it for 26k with an extended warrenty (to 7 years and 100k)..the car is used at the place i got my 8 but it only has 14k miles on it......lol can' ttest drive it to see if i really like it b/c i can't drive stick at the moment. :(

when i drive it...assuming it's still there when i get my hand back...it'll have a lot of competition to sway me from getting a new 8. but the extended warrenty is appealing. and it is less money......argh damn lady why'd you have to hit me...i wouldn't be stressed with all this stuff i fyou knew how to drive.

the insurrance guy checked out my car took him about 15-20 seconds to total it. lol tom. i fax him all the info abou tthe recalls i've had done and everythign else done to my car..ie engine and intake manifold, revi intake, mazdaspeed flywheel, and rev8 exhaust.

as for my hand i'm in a full cast now :( the orthopedic surgen (hand specialist) said i have a torn tendon in my thumb :(..cast will be on for a little over 4 weeks and then i'll have some physical theripy. :(...so merry christmas to me.

to ad fuel to the fire that has been my week....i go on vacation with my girl..we are going on a cruise in the carribean...lol and i can't get my cast wet...so i get to go to all these awsome islands and on a boat for a week..and don't get to go in the water. :(

awe well.....i wonder if that falls into the pain and suffering category

done and done..after i went to a back specialist (i'm in physical theripy now for my back :( ) and i see my hand doctor this thursday to schedule surgery on my thumb to re-attach a tendon i've secured a lawyer. smart guy..not the typical "lawyer" i would expect.

on a side note i've picked up a new auto.

i'm now an owner of a 2005 Honda s2000....my fiancee' picked up a 2007 civic si 9and since i got my car right after sh ego thers on the same night i got a very nice deal on it)..extended warrenty adn everythign etc. etc.

i'll get another 8 down the road....or if i'm luck a new 7 :)

yea the real kicker is .. teh intake manifold ignition system adn engine were all just replaced. :(.....but i wouldn't want any of that..when i removed my gauges and short shifter...i noticed that teh hole where the shifter comes through was elongated adn bent....from the shock of the impact the tranny went back a couple inches and forward about the same...lol so i don't think any of the drivetrain is good.....maybe the rear diff...the back of the car still looks great :)

Is the shifter okay? Still got it...? :naughty:

lol yea i have a few things i've salvaged off my car. axial flow short shifter, RP super cat, i also have a cabin air filter, and an engine air filter (for original air intake), i also have 3 BF guages (white) oil pressure oil temp, and water temp. no control unit (my leg hit it in the accedint and broke it open), and no sensors for the guages (they were in the engine bay which was crushed)

going to post in the wanted/for sale section one of these days

oo and 6 quarts of 5w20 royal purple..lol my new car doesn't take that grade

both me and my girl like out new cars.....the s2000 and rx8 perform about the same...the 8 is just smoother...and the s2000 is faster. but oh well both fun cars.

hopfully i win a lot..maybe i'll get anouther 8 :)

I can't believe I finally came across this thread. Sorry to hear about the accident and am glad that things have worked out.

Have fun in the S2K. Watch out for stupid drivers running red lights and other inane things. The S2K is even smaller than the 8.

I might have missed it but what did the insurance finally give you for the 8? Get a good deal on the Honda?
